Application No. 23-035: David Chu and Laura Tosi, c/o William F. Riley, Esq, PO Box 707, Chatham, MA 02633, owners of property located at 52 Homestead Lane, also shown on the Town of Chatham’s Assessors’ Map 15C Block 3 Lot 16.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 7.4 feet from the northerly abutter and 4.3 feet from the southerly abutter.  The proposed dwelling will be nonconforming in that it will be located 5.3 feet from the northerly abutter and 4.3 feet from the southerly abutter where a 15 foot setback is required.  The existing building coverage is 704 square feet (18.4%) and the proposed building coverage is 991 square feet (25.9%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 3,820 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.  Continued from May 25, 2023 and June 8, 2023.

Application No. 23-061: The 89 Taylor’s Pond Road Realty Trust, c/o James M. Norcross, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 89 Taylor’s Pond Road, also shown on the Town of Chatham’s Assessors’ Map 5C Block 29B Lot PT19.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a conforming lot via the construction of decks.  The existing dwelling is nonconforming in that it is located 48.5 feet from the Coastal Conservancy District.  The proposed deck will be nonconforming in that it will be located 47.1 feet from the Coastal Conservancy District where a 50 foot setback is required.  The lot contains 79,720 square feet in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 23-062: Hellberg Family 2014 Irrevocable Trust, c/o Chris Cannon, PO Box 201, Chatham, MA 02633, owner of property located at 163 George Ryder Road South, also shown on the Town of Chatham’s Assessors’ Map 7D Block 6 Lot 4.   The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the partial demolition the existing dwelling and construction of additions.  The proposed additions will comply with all bulk and dimensional requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.    The existing building coverage is 590 square feet (5.7%) and the proposed building coverage is 964 square feet (9.3%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 0 feet of frontage where 100 feet is required and contains 10,368 square feet where 20,000 square feet square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 23-063: Jonathan and Alicia Downs, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 41 Locust Lane, also shown on the Town of Chatham’s Assessors’ Map 15F Block 45 Lot 53. The Applicant seeks a Dimensional Variance from the requirements of Appendix II, to allow for the proposed elevated catwalk to be located 7.1 feet from the northerly abutter and 12.1 feet from the southerly abutter where a 15 foot setback is required.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.  Under Application No. 23-064, The Applicant seeks to extend an elevated catwalk in the Inland Conservancy District as allowed by Special Permit under Section IV.A.3.a. of the Protective Bylaw.  The lot contains 36,214 square feet in the R20 Zoning District. A Special Permit is required under M.G.L Chapter 40A Section 9 and Section VIII.D.2.b. of the Chatham Protective Bylaw.

Application No. 23-071: Francis X. Tirrell and James H Gavin, c/o Tom Hague III, PO Box 1394, Orleans, MA 02653, owners of property located at 149 Tirrells Way, also shown on the Town of Chatham’s Assessors’ Map 3E Block 53 Lot B16.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the replacement and expansion of the deck.  The existing deck is nonconforming in that it is located 6.4 feet from the southerly abutter.  The proposed deck will be nonconforming in that it will be located 6.4 feet from the southerly abutter where a 25 foot setback is required.  The lot is nonconforming in that it contains 17,846 square feet where 60,000 square feet square feet is required in the R60 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.
