Approval of Minutes – February 23, 2023

Application No. 23-011: Town of Chatham, c/o Theodore Keon, 261 George Ryder Road, Chatham MA 02633, owner of property located at 613 Stage Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 13A Block 2 Lot 24.  The Applicant seeks to replace access stairs as allowed by Special Permit under Section IV.A.3.a. of the Protective Bylaw.  The lot contains 1.31 acres in the M Zoning District. A Special Permit is required under M.G.L Chapter 40A Section 9 and Section VIII.D.2.b. of the Chatham Protective Bylaw.

Application No. 23-012: Susan B. Hamill, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 16 Scallop Terrace, also shown on the Town of Chatham’s Assessors’ Map 16A Block 28C Lot H14F.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in it is located 18 feet from the road, 13.5 feet from the northerly abutter, 5 feet from the easterly abutter, 5.6 feet from the southerly abutter and entirely within the Coastal Conservancy District (Flood Plain ele. 13).  The proposed dwelling will be nonconforming in that it will be located 18.1 feet from the road where 40 foot setback is required, the dwelling will be 13.5 feet from the northerly abutter, the deck will be 3.6 feet from the northerly abutter, 5 feet from the easterly abutter, 6.2 feet from the southerly abutter where a 25 foot setback is required and entirely within the Coastal Conservancy District where a 50 foot setback is required.    The existing building coverage is 674 square feet and the proposed building coverage is 674 square feet where 2,800 square feet is the maximum allowed.  The lot is nonconforming in that it contains 0 square feet of buildable upland where 20,000 square feet is required and contains 2,556 square feet of land area where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Protective Bylaw.  

Application No. 23-013: Gregory P. Manning and Jennifer L. Manning, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owners of property located at 356 Deer Meadow Lane, also shown on the Town of Chatham’s Assessors’ Map 7J Block 48 Lot C312.  The Applicant seeks a Dimensional Variance from the abutters setback requirement under Appendix II of the Protective Bylaw for the installation of an exterior mechanical system appliance (generator).  The generator was installed 20.3 feet from the easterly abutter where a 25 foot setback is required.  The lot contains 19,719 square feet in the R60 Zoning District.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.  

Application No. 23-014: Douglas C. DeStabler and Susan B. DeStabler, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 60 Eastward Road, also shown on the Town of Chatham’s Assessors’ Map 13M Block 15 Lot C34.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of screen porch. The existing dwelling is nonconforming in that it is located 39.9 feet from Eastward Road and 38.1 feet from Old Salt Works Road where a 40 foot setback is required, and 33 feet from the Coastal Conservancy District (Floodplain ele. 11) where a 50 foot setback is required.  The proposed screen porch will comply with setback requirements. The existing building coverage is 3,391 square feet and the proposed building coverage is 3,701 square feet where 2,900 square feet is the maximum allowed.  The lot is nonconforming in that it contains 23,169 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 23-015: James and Jennifer Mock, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA 02671, owners of property located at 32 Old Salt Works Road, also shown on the Town of Chatham’s Assessors’ Map 13L Block 1 Lot C32.  The Applicant seeks to modify Special Permit No. 21-048 granted on June 24, 2021, which allowed for the demolition of the existing dwelling and the construction of a new dwelling, garage with living space above and swimming pool.  The Applicant now seeks to modify this Special Permit to allow for an overhang to be located 48 feet from the Coastal Conservancy District.  The approved building coverage was 3,376 square feet (8.2%) and the constructed building coverage is 3,416 square feet (8.3%) where 10% is the maximum allowed.  The lot contains 44,899 square feet is in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Protective Bylaw.

Application No. 23-001: Robert Fogel and Ellen Mahoney, c/o James McGrath, 259 Queen Anne Road, Harwich, MA 02645, owners of property located at 9 Power Lane, also shown on the Town of Chatham’s Assessors’ Map 9K Block 18 Lot LP9.  The Applicant seeks a Dimensional Variance from the abutters setback requirement under Appendix II of the Protective Bylaw for the construction of an accessory structure (pool house).  The pool house was installed 22 feet from the southerly abutter where a 25 foot setback is required.  The lot contains 20,535 square feet in the R60 Zoning District.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.  Continued from February 9, 2023 and February 23, 2023.
