Application No. 23-031: Philip and Laurie Dumas, c/o William F. Riley, Esq, PO Box 707, Chatham, MA 02633, owner of property located at 67 Palmer Drive, also shown on the Town of Chatham’s Assessors’ Map 15G Block 37 Lot P7.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 12.6 feet from the westerly abutter and 22.2 feet from the southerly abutter.  The proposed dwelling will be nonconforming in that it will be located 8 feet from the westerly abutter and 17 feet from the southerly abutter where a 25 foot setback.  The existing building coverage is 888 square feet (8.9%) and the proposed building coverage is 1,485 square feet (14.8%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 10,004 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.  Continued from May 4, 2023, June 8, 2023 and July 13, 2023.

Application No. 23-077: Rockland Trust Company, c/o James M. Norcross, Esq. P.O. Box 707 Chatham, MA 02633, lessee of property located at 649 Main Street, also shown on the Town of Chatham’s Assessors’ Map 14E Block 2 Lot X48A. The Applicant proposes to establish and operate a Formula Business (bank) under Section III.C.4.c of the Protective Bylaw.  The Applicant is and proposes to do business as a bank, which utilizes a standard array of services, logo, symbol and signage utilized by ten or more other businesses worldwide.  The unit contains approximately 968 square feet and is located in the GB1 Zoning District.  A Special Permit is required under Section III.C.4.c. and Section VIII.D.2.b. of the Chatham Protective Bylaw.

Application No. 23-078: Seashell Island Realty LLC, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 19 Island View Lane, also shown on the Town of Chatham’s Assessors’ Map 5D Block 42 Lot F3.  The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the construction of additions and a garage. The existing dwelling, proposed additions and garage will comply with all bulk and dimensional requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The existing building coverage is 1,136 square feet (6.5%) and the proposed building coverage is 2,591 square feet (14.9%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 17,407 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. 

Application No. 23-079: Jeffrey Ethier, c/o Kevin Gray, 217 Captain Beers Plain Road, Northfield, MA 01360, owners of property located at 16 Aunt Lydia’s Way, also shown on the Town of Chatham’s Assessors’ Map 16G Block 3B Lot A3.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the replacement of the elevated deck with a covered porch.  The existing building coverage is 3,138.5 square feet and the proposed building coverage is 3,501.9 square feet where 2,950 square feet is the maximum allowed.  The lot is nonconforming in that it contains 26,334 square feet where 40,000 square feet square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 23-080: Matthew Damian Bober and Nancy Bober, c/o Thadd Eldredge, 1038 Main Street, Chatham, MA 02633, owners of property located at 70 Strong Island Road, also shown on the Town of Chatham’s Assessors’ Map 13M Block 37 Lot C14.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the removal of bay windows and the construction of decks.  Also proposed is the installation of fencing and a boulder wall with stone steps within the Coastal Conservancy District (floodplain ele. 11) and the relocation of exterior mechanical system appliances (A/C condensers) and the addition of a generator.  The existing dwelling is nonconforming in it is located 34.8 feet from Strong Island Road, 24.8 feet from the easterly abutter, and 1 foot from the Coastal Conservancy District.  The existing exterior mechanical system appliances are nonconforming in that they are located 17.4 feet from the easterly abutter.  The proposed decks will be nonconforming in that one will be located 35.2 feet from Strong Island Road where a 40 foot setback is required and 8 feet from the Coastal Conservancy District where a 50 foot setback is required.  The other deck will be nonconforming in that it will be located 23.2 feet from the easterly abutter where a 25 foot setback is required and 0 feet from the Coastal Conservancy District where a 50 foot setback is required.    The exterior mechanical system appliances will be nonconforming in that they will be located 19.5 feet from the easterly abutter where a 25 foot setback is required.  The existing building coverage is 2,058 square feet (18.9%) and the proposed building coverage is 2,040 square feet (18.5%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 10,900 square feet of buildable upland where 20,000 square feet is required and contains 22,424 square feet of land area where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Protective Bylaw.  

Application No. 23-087: 70 Sears Point Lane Realty Trust c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 70 Sears Point Lane, also shown on the Town of Chatham’s Assessors’ Map 11A1 Block 7 Lot 5.  The Applicant seeks a Dimensional Variance from the land area required for a previously reconfigured parcel.  The parcel located at 70 Sears Point Lane contains 30,454 square feet where 40,000 square feet of land area is required for a parcel located in the R40 Zoning District.  A Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c. of the Protective Bylaw.
