LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, October 27, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-077: Anthony and Kathleen Gazzola, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at 6 Pine Drive, also shown on the Town of Chatham’s Assessors’ Map 6C Block 52 Lot J126. The Applicant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via the addition of dormers and a second floor deck.  The existing dwelling (deck) is nonconforming in that it is located 8.8 feet from the road where 25 feet is required.  The proposed dormers will comply with road and abutters setback requirements. The proposed second floor deck is nonconforming in that it will be located 20 feet from the road where 25 feet is required.  The existing and proposed building coverage is 1,329 square feet (15.4%) where 15% is the maximum allowed. The lot is nonconforming in that it contains 8,641 square feet where 20,000 square feet is required in an R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section VB of the Chatham Protective Bylaw.

Application No. 16-078: Donald and Patricia MacNaughton, c/o Robert Perry, Cape Cod Engineering, Inc., Box 1517, East Dennis, MA  02641, owners of the property located at 213 Seapine Road, also shown on the Town of Chatham’s Assessors’ Map 12K Block 2 Lot HC16A.  The Applicants seek to construct a 72 square foot observation platform and to permit and maintain an existing walkway and stairway, within the Conservancy District.   The total lot size is 49,185 square feet and the property is located within the R40 Zoning District.  A Special Permit is required under Section IV.A.3 of the Chatham Protective Bylaw.  

Application No. 16-079: Eastward Homes Business Trust, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at Lot 16 Hydrangea Lane, also shown on the Town of Chatham’s Assessors’ Map 13F, Block 29, Lot H14. The Applicant proposes to construct a single family dwelling in a GB3 zone which requires the grant of a Special Permit.  The proposed dwelling will comply with all bulk and dimensional requirements of the bylaw.  The lot is conforming 15,780 square feet where 10,000 square feet is required in a GB3 Zoning District.  A Special Permit is required under Section III.C.4.c.26 of the Chatham Protective Bylaw.

Application No. 16-080: Eastward Homes Business Trust, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at Lot 17 Hydrangea Lane, also shown on the Town of Chatham’s Assessors’ Map 13F, Block 29, Lot H17. The Applicant proposes to construct a single family dwelling in a GB3 zone which requires the grant of a Special Permit.  The proposed dwelling will comply with all bulk and dimensional requirements of the bylaw.  The lot is conforming 16,519 square feet where 10,000 square feet is required in a GB3 Zoning District.  A Special Permit is required under Section III.C.4.c.26 of the Chatham Protective Bylaw.

Application No. 16-081: Eastward Homes Business Trust, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at Lot 18 Hydrangea Lane, also shown on the Town of Chatham’s Assessors’ Map 13F, Block 29, Lot H18. The Applicant proposes to construct a single family dwelling in a GB3 zone which requires the grant of a Special Permit.  The proposed dwelling will comply with all bulk and dimensional requirements of the bylaw.  The lot is conforming 17,712 square feet where 10,000 square feet is required in a GB3 Zoning District.  A Special Permit is required under Section III.C.4.c.26 of the Chatham Protective Bylaw.

Appeal No. 16-082: Melanie Garrison, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 279 Woodland Way, also shown on the Town of Chatham’s Assessors’ Map 11K, Block 11, Lot HC112 and Map 11K, Block 10A, Lot HC154. The Applicants seek to construct a 90 linear foot unpaved path within the Conservancy District.  The path will be located on 0 Woodland Way (Map 11K, Block 10A, Lot HC154) which is owned by 279 Woodland Way.  The property is located within the R40 Zoning District.  A Special Permit is required under Section IV.A.3.a of the Chatham Protective Bylaw.
