LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, January 14, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-086: Theresa E. Redmond, c/o Peter Eastman, Peter Eastman Custom Builder, 144 Fisk Street, West Dennis, MA  02670, owner of property located at 42 Deep Hole Road, also shown on the Town of Chatham’s Assessors’ Map 2B Block 37 Lot G4.    The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of two additions to the north and south of the existing breezeway.  The existing dwelling is nonconforming in that its westerly abutter’s setback is 10.3 feet and its easterly abutter’s setback is 14.9 feet where 15 feet is required.  The existing building coverage is nonconforming at 1,513 square feet (16.9%) and the proposed building coverage will also be nonconforming at 1,733 square feet (19.4%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 8,950 square feet where 20,000 square feet is required and 93.94 feet of frontage where 100 feet is required in the R-20 Zoning District.  A Special Permit is required under Section V.B. of the Chatham Protective Bylaw.  

Application No. 15-087: Mark and Jane Johnson, c/o Jim Hagerty, Reef Realty, 24 School Street, P.O. Box 186, West Dennis, MA  02670, owners of property located at 28 Pine Drive, also shown on the Town of Chatham’s Assessors’ Map 6C Block 50 Lot J10.    The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that its road setback is 21.1 feet where 25 feet is required.  The proposed dwelling will also be nonconforming in that its road setback is 23.5 feet where 25 feet is required.  The existing building coverage is 863 square feet (12.5%) and the proposed building coverage is 1,034 square feet (14.98%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 6,900 square feet where 20,000 square feet is required in the R-20 Zoning District.  A Special Permit is required under Section V.B. and Section V.III.D.2.b. of the Chatham Protective Bylaw.  

Application No. 15-089: Michael A. Powers, c/o William G. Litchfield, Esq. 330 Orleans Rd, North Chatham, MA  02650, agreed lessee of property located at 2485 Main Street, also shown on the Town of Chatham’s Assessors’ Map 4D Block 54 Lot 27A.    The Applicant proposes to establish and operate a Formula Business (professional office, life insurance) under Section III.C.4.c of the Protective Bylaw.  The Applicant is and proposes to do business as an agent for New York Life Insurance, which utilizes a standard array of services, logo, and color scheme utilized by ten or more other businesses worldwide.  The office will include 449.59 square feet and 109.02 square feet of storage.  There are no changes proposed to the existing structure, and the sign has been approved by the Historic Business District Commission.  The use of a portion of the structure as a professional office was approved under Special Permit No. 13-075.  The lot contains 17,532 square feet 20,000 square feet are required in the SB Zoning District.  A Special Permit is required under Section III.C.4.c. and VIII.C. and D. of the Chatham Protective Bylaw.

Application No. 15-090: Edward J. Skopas, Trustee, c/o William G. Litchfield, Esq. 330 Orleans Rd, North Chatham, MA  02650, owner of property located at 214 Stage Island Road, also shown on the Town of Chatham’s Assessors’ Map 13A1 Block 7 Lot D165.    The Applicant proposes to change, alter or expand a nonconforming dwelling on a nonconforming lot via the construction of a covered porch on the east side and an addition on the north side of the dwelling, the alteration of various architectural details, and change to the upper story on the existing footprint but within the Coastal Conservancy District setback.  The existing dwelling is nonconforming in that it is located 11 feet from the top of the coastal bank where 50 feet is required.  The existing building coverage is 2,317 square feet (16.3%) and the proposed building coverage is 2,402 square feet (16.9%) where 15% is the maximum allowed.  The existing height of the ridge is 30.2 feet and the proposed height of the ridge will be 30.7 feet where 30 feet is the maximum allowed.  The lot is nonconforming in that it contains 14,193 square feet of buildable upland where 20,000 square feet is required.  The lot contains 50,400 square feet where 40,000 square feet is required in the R-40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B.  of the Chatham Protective Bylaw.

Application No. 13-062: Thomas G. Flynn, 699 Orleans Road, North Chatham, MA  02650, c/o Thomas Aylesworth, Esq.,45 Braintree Hill Office Park, Suite 107, Braintree, MA  02184, appealed the determination of the Chief Zoning Officer that the property located at 693 Orleans Road, owned by Valerie Seyfert Piper, also shown on the Town of Chatham Assessors Map 12I, Block 15, Lot 2, has been continuously used for the purpose of operating a kennel as defined in the Chatham Protective Bylaw.  The property contains 43,522 square feet in an R-40 Zoning District.  The Applicant appealed under Section VIII.D.2.a. Administration, Powers, Appeals, of the Protective Bylaw.  The Zoning Board of Appeals upheld the Decision of the Chief Zoning Officer and the Applicant appealed to Land Court.  Since then, the land court has asked the parties to enter into an agreement due to the mootness of the issue. Thus the board will consider and vote to rescind its denial of the enforcement request solely on the ground that it is moot because there is nothing to enforce as the kennel operation has ceased.
