LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, May 4, 2017, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 17-018: 20 45 Chatham Bars Ave LLC, c/o Andrew L. Singer, Esq., PO Box 67, Dennisport, MA 02639, owner of property located at 45 Chatham Bars Avenue, also shown on the Town of Chatham’s Assessors’ Map 15D Block 39 Lot 16C.  The Applicant seeks a Special Permit for interior and exterior storage, maintenance offices and workshop, with conditions, under Section I.C. of the Bylaw, seeking a determination that a use not specifically listed should be authorized.  The structure will continue to be nonconforming with a road setback of 3.5 feet where 25 feet is required.  The existing and proposed building coverage will remain nonconforming at 9,984 square feet (27.7%) where 15% is the maximum allowed.  The property contains 36,018 square feet in an R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section 9 and Section I.C., V.B. and VIII.D.2.b. of the Protective Bylaw.   

Application No. 17-021: Matthew and Susan Botein, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 102 Cedar Street, also shown on the Town of Chatham’s Assessors’ Map 13C Block 40 Lot 10. The Applicant proposes to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the construction of additions on the northerly side of the dwelling.  The existing dwelling is nonconforming in that it is located 20 feet from the Coastal Conservancy District where a 50 foot setback is required.  The proposed additions will be located 26 feet from the Coastal Conservancy District.  The lot is conforming in that it contains 118,800 square feet where 40,000 square feet is required but is nonconforming in that it contains 125 feet of frontage where 150 feet is required in an R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 17-026: Jannell Brown, owner of the property located at 212C Orleans Road, also shown on the Town of Chatham’s Assessors’ Map 14H Block 64 Lot X212C.  The Applicants seeks an Appeals Permit under Section 225-19 of the Town of Chatham Sign Bylaw, to allow the placement of a 12 inch by 120 inch (10 square feet) wall sign where 1 square foot is the maximum allowed.  This sign is proposed to be located on an existing sign backer board located above the door to a commercial condominium unit in the courtyard area of Nickerson Corners, a mixed use commercial condominium complex located in both the SB and R40 Zoning Districts.  This particular unit is located in the SB Zoning District.  The proposed sign requires an Appeals Permit under Section 225-19 and Section 225-24 of the Chatham Sign Bylaw.    

Application No. 17-027: Eastward MBT LLC, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owner of the property located at Lot 18 Hydrangea Lane, also shown on the Town of Chatham’s Assessors’ Map 13F Block 29 Lot H18.  The Applicant seeks a Variance under Section VIII.D.2.c. from the requirements of Appendix II, to locate a single family dwelling 32 feet from the road where a 50 foot setback is required.  Special Permit No. 16-081 was granted on November 3, 2016 which allowed for the construction of a single family dwelling in the GB3 Zoning District.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.     

Application No. 17-030: Frederik and Caren Morse, owner of the property located at 75 Old Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 14E Block 56 Lot 35.  The Applicants seeks an Appeals Permit under Section 225-19 of the Town of Chatham Sign Bylaw, to allow the replacement of a pre-existing nonconforming 24 inch by 72 inch (12 square foot) roof sign with a new 36 inch by 84 inch (21 square foot) roof sign in the SB Zoning District.  The proposed sign requires an Appeals Permit under Section 225-19 and Section 225-24 of the Chatham Sign Bylaw.    

Application No. 17-031: 595 Main Street LLC, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 639-647 Main Street, also shown on the Town of Chatham’s Assessors’ Map 15E Block HIGHW Lot SQUARE.  The Applicant seeks a Special Permit to change the use of the lower rear units from retail to an 18 bed dormitory.  The lot is nonconforming in that it contains 115,140 square feet of buildable upland where 197,000 square feet is required for the existing and proposed uses on the property. The lot contains 116,067 square feet in a GB1 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 9 and Sections V.B., VII.B.11 and VIII.D.2.b. of the Protective Bylaw.
