LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, October 22, 2015, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-063: Linda Apsey,  owner of property located at 216 C Orleans Road, North Chatham, MA  02650, also shown on the Town of Chatham’s Assessors’ Map 14H, Block 64, Lot 216C.  Applicant seeks an Appeals Permit under Section 225-19 of the Town of Chatham Sign Bylaw, to allow the placement of a 11 ½ inch by 92 ½ inch sign (7.31 square feet) where 6 square feet is the maximum allowed.  This sign is proposed to be located on an existing sign backer board located above the door to a commercial condominium unit in the courtyard area of Nickerson Corners, a mixed use commercial condominium complex located in both the SB and R40 Zoning Districts.  This particular unit is located in the R-40 Zoning District.  The proposed sign requires an Appeals Permit under Section 225-10 and Section 225-19 of the Chatham Sign Bylaw.    

Application No. 15-064: Kim L. Farber, c/o Peter S. Farber, Esq., Box 768, North Chatham, MA  02650,  owner of property located at 57 Winter Home Road, also shown on the Town of Chatham’s Assessors’ Map 7G Block 30 Lot M65.    The Applicant proposes to enlarge, extend, or change a nonconforming structure (garage) via the removal of the roof and construction of a new roof with dormers and replacement and expansion of the stairs located within the westerly setback.   The existing structure (garage) is nonconforming in that its westerly abutter’s setback is 14.8 feet where 15 feet is required.  The existing and proposed building coverage is nonconforming at 3,432 square feet (10.5%) where 3,253 square feet (10%) is the maximum allowed.   The lot contains 36,510 square feet where 30,000 square feet is required and is located within the R-30 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 15-065: Chatham Beach and Tennis Club, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650,  owner of property located at 14 Main Street, also shown on the Town of Chatham’s Assessors’ Map 16B Block 1 Lot 73.    The Applicant seeks a modification of Special Permit No. 12-003, issued on January 20, 2012, to allow for an increase in the size of the deck approved for the southeasterly side of the building from 369 square feet to 458 square feet resulting from a proposed increase in the width of the deck from 8 feet to 10 feet.  The existing Special Permit is still viable under the Permit Extension Act, as amended, and allowed for alteration and expansion of a nonconforming structure; the use (private, not-for-profit club) is pre-existing and allowed in the R-40 Zoning District only by Special Permit.  In the alternative, the Applicant seeks a Special Permit for the relief set forth above in Section V.B. of the Protective Bylaw.  The existing structure is nonconforming in that it has a road setback of 10 feet where 40 feet is required.  The existing and proposed building coverage is 3,658 square feet (5.9%) where 10% is the maximum allowed.  The lot contains 209,000 square feet and is located within the R-40 Zoning District.  The Special Permit sought to be modified was granted under M.G.L. Chapter 40A, Section 6, and V.B. and Section VIII of the Protective Bylaw.

Application No. 15-068: Neal A. and Mary Ellen Sobol, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650,  owners of property located at 25 Glover Square, also shown on the Town of Chatham’s Assessors’ Map 14F Block 60 Lot P5.    The Applicants seek to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of a second floor addition of 388 feet, a sun porch of 130 square feet, and a deck on the west side of the dwelling.  The additions will meet all dimensional requirements and will increase coverage from 1,856 square feet (10.4%) to 2,244 square feet (12.6%) where 15% is allowed but are considered a substantial alteration to a nonconforming dwelling on a nonconforming lot.  The existing dwelling is nonconforming in that a portion of it is located 9.5 feet from the southerly abutter’s setback where 15 feet is required.  The lot is nonconforming in that it contains 17,867 square feet of buildable upland where 20,000 square feet is required.  The total lot area is 25,780 square feet where 20,000 square feet is required in an R-20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 15-071: Beatrice L. and Eunice F. Chase, c/o George Reilly, 63 Brooktrail Road, Brewster, MA  02631, the owners of property located at 70 Rowland Drive, also shown on the Town of Chatham’s Assessors’ Map 13J, Block 18, Lot AR5. The Applicants seek to amend Special Permit 14-003 granted February 27, 2014 which allowed the Applicant to change, alter, expand a nonconforming single family dwelling via the construction of an addition consisting of 452 square feet and 145 square feet of porches, resulting in an increase of 619 square feet for a total building coverage of 2,085 square feet, or 16.8%.  The Applicant now seeks to amend Special Permit No. 14-003 to reduce the size of the screened porch and remove the proposed second floor addition over the screened porch.  The proposed building coverage is now 14.9% where 15% is allowed, and the encroachment into the Conservancy District is now 11 feet.   The property is nonconforming in that it has 12,400 square feet of buildable upland where 20,000 square feet is required.  The dwelling is nonconforming in that it has an abutter setback of 9 feet where 25 feet is required.  The lot is also nonconforming as to Conservancy District setback at -9.9 feet where 50 feet is required.  The property is located in the R40 Zoning District.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change and Section VIII.D.2.b. of the Protective Bylaw.

Application No. 15-047: Eastward Company, c/o William F. Riley, Esq., 156 Crowell Road, Box 707, Chatham, MA  02633, agreed vendee of property located at 78 Crowell Road, also shown on the Town of Chatham’s Assessors’ Map 13F Block 29 Lot H14.  The Applicant seeks to enlarge, extend, or change a nonconforming use of two (2) medical Offices and three (3) apartments in a pre-existing nonconforming building to five (5) free-standing single family dwellings on a single property, pursuant to the provisions of Section V.B. and Section I.C. in that the proposed use is substantially similar in size, operation, impacts and other proposed characteristics to permitted uses specifically listed in the district.  The existing road setback is 47.7 feet and the proposed road setback is 35 feet where 50 feet is required.  The existing building coverage is 2,529 square feet (4.3%) and the proposed building coverage is 20,128 square feet (34.2%) where there is no requirement.   The lot contains 58,781 square feet where 10,000 square feet is required in a GB-3 Zoning District.  A Special Permit is required under Section V.B. and I.C., of the Chatham Protective Bylaw.
