LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, July 14, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-022: Allan and Eliza Royal, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA 02671, owners of property located at 416 Main Street, also shown on the Town of Chatham’s Assessors’ Map 16D, Block 37, Lot 8. The Applicant is requesting the grant of a Special Permit to convert an existing nonconforming use of an apartment incidental to a commercial use to a multi-family dwelling.   Also proposed are the construction of a front porch 15.73 feet from the road where 25 feet is required and the construction of a swimming pool. The swimming pool will comply with the dimensional requirements of the Bylaw but requires a Special Permit in the General Business Zone.  The existing structure is nonconforming in that it is setback 22.83 feet from the road. The lot contains 18,627 square feet in the GB2 and R20 Zoning Districts.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, Section V.B. and Section III.C.4.c, of the Chatham Protective Bylaw.

Application No. 16-041: John and Tanya Lund, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at 203 Champlain Road, also shown on the Town of Chatham’s Assessors’ Map 12A, Block 9, Lot 7. The Applicant proposes to remove a pre-existing nonconforming single family dwelling and demolish a pre-existing nonconforming garage/guesthouse on a nonconforming lot via the relocation of the existing dwelling to an adjacent lot and construction of a new dwelling and garage/guesthouse. The existing dwelling is setback 14.7 feet from the westerly abutters setback and 15.2 feet from the easterly abutters setback where 25 feet is required. The proposed dwelling will be setback 15.4 feet from the westerly abutters setback and 15.3 feet from the easterly abutters setback where 25 feet is required. The existing garage/guesthouse is setback 19.2 feet from the westerly abutters setback and 20.5 feet from the easterly abutters setback where 25 feet is required.   The proposed garage/guesthouse is setback 17.4 feet from the westerly abutters setback and 18.6 feet from the easterly abutters setback where 25 feet is required.  Also proposed is the installation of Exterior Mechanical System Appliances (Generator and Air Conditioning Units) 14 feet from the easterly abutters setback where 25 feet is required.  The lot is nonconforming in that it has 12.17 feet of frontage where 150 feet is required and contains 26,136 square feet where 40,000 square feet is required in the R-40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B. of the Protective Bylaw.     

Application No. 16-042: John and Tanya Lund, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at 181 Champlain Road, also shown on the Town of Chatham’s Assessors’ Map 12A, Block 8, Lot 7A. The Applicant proposes to remove a pre-existing nonconforming single family dwelling on a nonconforming lot and replace it with the existing dwelling on the adjacent property (230 Champlain Road). The existing dwelling is setback 11 feet from the road where 40 feet is required. The proposed dwelling will be setback 14 feet from the road where 25 feet is required.  The existing and proposed westerly abutter setback is 15.3 feet where 25 feet is required.  Also proposed is the installation of Exterior Mechanical System Appliance (Air Conditioning Units) 11 feet from the road where 40 feet is required.  The lot is nonconforming in that it contains 26,136 square feet where 40,000 square feet is required in the R-40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B. of the Protective Bylaw.     

Application No. 16-045: 512 W LLC, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA  02671, owners of the property located at 512 Main Street, also shown on the Town of Chatham’s Assessors’ Map 15D Block 35 Lot 80.  The Applicants seek to change, alter or extend a pre-existing nonconforming commercial hotel/inn via an increase in the number of guest rooms from 56 to 59 by remodeling and extending an existing second floor space in building 2.  The applicant proposes to reduce the restaurant seating by 16 seats in order to offset any impact to parking or wastewater.   The existing hotel/inn is nonconforming in that building 1 is located 3.1 feet from the southerly abutter’s setback where 5 feet is required in the GB1 Zoning District.  The extensions to building 2 will conform to the abutter’s setback of 15 feet in the R20 Zoning District.  The lot contains 1.75 acres in the GB1 and R20 Zoning Districts.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. and of the Chatham Protective Bylaw.

Application No. 15-046: Gordon and Susan Melville, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 71 Eldredge Square, also shown on the Town of Chatham’s Assessors’ Map 14F Block 42 Lot ME4.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of a second story and a single story addition connecting the existing dwelling to the garage.  The proposed addition and deck will comply with the required setbacks.  The existing dwelling is nonconforming in that it has a road setback to Eldredge Square of 17.9 feet and a road setback from Surrey Lane of 22.1 feet where 25 feet is required from both streets.  The existing building coverage is 1,429 square feet (17.7%) and the proposed building coverage is 1,635 square feet (20.3%) where 15% is the maximum allowed.   The lot is nonconforming in that it contains 60.39 feet of frontage where 100 feet of frontage and contains 8,055 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B., of the Chatham Protective Bylaw.
