LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, October 11, 2018, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 18-063: Jeffrey and Jayne Chandler, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owners of property located at 24 Windmill Lane, also shown on the Town of Chatham’s Assessors’ Map 16A Block 18 Lot H2.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and construction of a new dwelling.  The existing dwelling is nonconforming in that it is located entirely within the Coastal Conservancy District (Flood Plain ele. 13), is located 35.5 feet from the road, 21.8 feet from the westerly abutter and 11.7 feet from the easterly abutter.  The proposed dwelling will be nonconforming in that it will be located within Coastal Conservancy District where a 50 foot setback is required, will be located 35.5 feet from the road where a 40 foot setback is required, 22 feet from the westerly abutter and 11.7 feet from the easterly abutter where a 25 foot setback is required.  The existing building coverage is 1,668 square feet (5.7%) and the proposed building coverage is 2,625 square feet (9%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 100 feet of frontage where 150 feet is required, contains 0 square feet of buildable upland where 20,000 square feet is required and contains 29,200 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.  Continued from August 23, 2018.  

Application No. 18-076: James and Cynthia Marsh, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 271 Stage Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 14C Block 45 Lot 42A.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and shed and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 32.7 feet from the road.  The proposed dwelling will be nonconforming in that it will be located 30 feet from the road where a 40 foot setback is required.  The existing building coverage is 2,449 square feet and the proposed building coverage is 3,000 square feet where 3,000 square feet is the maximum allowed.  The lot is nonconforming in that it contains 29,757 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 18-077: Timm and Katherine Tobin, c/o Thomas A. Moore, PO Box 2124, Brewster, MA 02631, owners of property located at 159 Vineyard Avenue, also shown on the Town of Chatham’s Assessors’ Map 10D Block 89 Lot D122.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition.  The existing dwelling is nonconforming in that it is located partially within the Coastal Conservancy District (Flood Plain ele. 11).  The proposed addition will be nonconforming in that it will be located within the Coastal Conservancy District where a 50 foot setback is required.  The existing building coverage is 1,040 square feet (9.2%) and the proposed building coverage is 1,704 square feet (14.7%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 11,532 square feet of buildable upland where 20,000 square feet is required and contains 17,287 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 & 9 and Sections V.B & VIII.D.2.b. of the Chatham Protective Bylaw.  

Application No. 18-078: Christopher J. and Elizabeth M. McCormick, c/o Eastward Companies, 155 Crowell Road, Chatham, MA 02633, owners of property located at 66 Woodland Way, also shown on the Town of Chatham’s Assessors’ Map 12K Block 28 Lot HC83.  The Applicant seeks to modify Special Permit No. 17-116 granted on January 25, 2018, which allowed for the demolition of the existing dwelling and the construction of a new dwelling.  The Applicant now seeks to modify Special Permit No. 17-116 to allow for an alternate location and larger footprint.  All other aspects of the previous approval, including the conditions imposed are proposed to remain unchanged.  The building coverage approved under Special Permit 17-116 was 2,347 square feet and the proposed building coverage will be 2,417 square feet where 2,900 is the maximum allowed.  The lot is nonconforming in that it contains 23,561 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 9 and Section VIII.D.2.b. of the Chatham Protective Bylaw.

Application No. 18-079: Paul and Patricia Swenson, c/o Theodore Streibert, 15 Linden Tree Lane, Chatham, MA 02633, owners of property located at 3 Scallop Terrace, also shown on the Town of Chatham’s Assessors’ Map 15A Block 9C Lot H14A.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and construction of a new dwelling.  Also proposed is the construction of a new driveway.  The dwelling is and will remain nonconforming as it is located entirely within the Coastal Conservancy District (Flood Plain ele. 13) where a 50 foot setback is required.  The existing dwelling is nonconforming in that it is located 3.2 feet from the Scallop Terrace, 11.7 feet from the southwesterly and the temporary landing is located 17.1 feet from Seagull Road which replaced the deck located 4.4 feet from Seagull Road which had been destroyed during the 2018 winter storm events.  The proposed dwelling will be nonconforming in that it will be located -0.4 feet from the Scallop Terrace where a 40 foot setback is required, 11.6 feet from the southwesterly abutter where a 25 foot setback is required and 8.3 feet from Seagull Road where 40 feet is required.  The building coverage will remain 767 square feet where 2,800 square feet is the maximum allowed.  The lot is nonconforming in that it contains 0 square feet of buildable upland where 20,000 square feet is required and contains 5,709 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.
