LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, May 22, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-030: Robert M. Alter, Trustee for 202 Eastward Road Nominee Trust, 42 Old Colony Road, Wellesley, MA  02481, c/o William G. Litchfield, 330 Orleans Road, North Chatham, MA  02650, owner of property located at 202 Eastward Road, also shown on the Town of Chatham’s Assessors’ Map 13M, Block 25, Lot C50.   Appellants propose to change, alter, or extend a nonconforming dwelling on a nonconforming lot via the demolition of the existing structure and construction of a new dwelling.  The existing dwelling is nonconforming as it is located 19.1 feet from the easterly abutter’s setback, with exterior mechanical system appliance located 15 feet from the easterly lot line, and 24.9 feet from the westerly abutter’s setback where 25 feet is required, and 44.6 feet from the Coastal Conservancy District where 50 feet is required.  The existing dwelling is nonconforming in that it covers 3,066 square feet (13.9%) where maximum building coverage is 2,850 square feet.  The lot is nonconforming in that it has 118 feet of frontage where 150 feet is required.  The proposed dwelling will be located 23.4 feet from the easterly lot line, with exterior mechanical system appliance 18.8 feet from the easterly lot line, and existing pool equipment to remain, all where 25 feet is required, and cover 3,393 square feet (15.4%) where the maximum building coverage is 2,850 square feet.  The proposed dwelling also meets the required setback from the Coastal Conservancy District of 50 feet.  The lot contains 44,930 square feet.  The Zoning District is R-40.  A Special Permit is required under Section V.B., Non-Conforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective By-Law.

Appeal No. 14-031: Gregg and Laura Kelley, 10 Briarwood Lane, Winchester, MA  01890-3868, c/o Polhemus Savery DaSilva, 101 Depot Road, Chatham, MA  02633, owner of property located at 136 Shattuck Place, Chatham, MA, also shown on the Town of Chatham’s Assessors’ Map 14C, Block 36, Lot F10. The appellant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via demolition of the existing dwelling and construction of a new dwelling.  The existing dwelling is nonconforming as its easterly abutter’s setback is 18.7 feet where 25 feet is required.  The existing building coverage is 2,553 square feet (6.4%), the proposed building coverage is 2,823 square feet (7.1%).  The proposed dwelling will comply with setback requirements.  The lot is nonconforming as it contains 39,714 square feet where 40,000 is required. The lot is in the R40 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-032: Eastward MBT, LLC, Trustee, Eastward Companies Business Trust/Stephen & Margaret Hecht, 155 Crowell Road, Chatham, MA  02633, owners of property located at 11 & 15 Shattuck Place, Chatham, MA, also shown on the Town of Chatham’s Assessors’ Map 15D, Block 98, Lot 73. The appellants propose to change, alter, or expand a nonconforming structure via the installation of three exterior mechanical system appliances on the north side of the existing dwelling at 11 Shattuck Place, 5 feet from the northerly abutter’s setback where 15 feet is required.  The appellant also proposes two exterior mechanical system appliances on the northeast side of the existing dwelling at 15 Shattuck Place, ten feet from the northerly abutter’s setback where 15 feet is required.  The existing lot is nonconforming in that it contains 65.5 feet of frontage where 100 feet is required and contains two dwellings on insufficient lot size.  The existing dwelling at 11 Shattuck Place is nonconforming in that the road setback is 21.5 feet where 25 feet is required and northerly abutters setback of 8.8 feet where 15 feet is required.  The existing dwelling at 15 Shattuck Place is nonconforming in that the northerly abutter’s setback is 10 feet where 15 feet is required and southerly abutter’s setback is 14 feet where 15 feet is required. An 8 X10 garden shed is proposed to be located on the east side of the property at 15 Shattuck Place.  Existing building coverage is 3,144 (13.9%) and the proposed building coverage is 3,240 square feet (14.3%) which exceeds the maximum building coverage of 2,900 square feet.  The existing lot contains 22,640 square feet where 20,000 square feet is required.  The lot is in the R20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-033: Dana L. and Lisa T. Roy, 3727 Darcus Street, Houston, TX  77005, c/o William G. Litchfield, 330 Orleans Road, North Chatham, MA  02650, owner of property located at 38 Shattuck Place, also shown on the Town of Chatham’s Assessors’ Map 15D, Block 105, Lot 7.   Appellant proposes to change, alter, or extend a nonconforming dwelling on a nonconforming lot via the relocation of the existing 687 square foot barn, the elimination of the shed additions, and the addition of a 153 square foot screened porch.  The barn is nonconforming in that it is located 11.2 feet from the northerly abutter’s setback where 15 feet is required; as relocated, it will be 10.7 feet from the abutter’s setback.  Existing building coverage is nonconforming at 18.7% where 15% is the maximum.  The lot is nonconforming in that, in addition to the nonconforming barn, it contains a dwelling which is 9.2 feet from the southerly abutter’s setback and 12.2 feet from the northerly abutter’s setback where 15 feet is required.  The lot is nonconforming in that it contains 42.3 feet of frontage where 100 feet is required, and contains 12,230 square feet where 20,000 square feet is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B., Non-Conforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective By-Law.

Appeal No. 14-034: Michael and Andrea Towey, 15 Pennoyer Street, Norwalk, CT  06853, c/o Duane P. Landreth, Esq., 8 Cardinal Lane, PO Box 2300, Orleans, MA  02653, owner of property located at 52 Tisquantum Road, Chatham, MA, also shown on the Town of Chatham’s Assessors’ Map 14A2, Block 6B, Lot N158. The appellant proposes to change, alter, or expand a nonconforming structure via demolishing the existing dwelling and reconstruct a new dwelling with additions and a detached garage.  The existing dwelling is nonconforming in that its northeast abutter’s setback is 37.4 feet where 40 feet is required.   The existing dwelling is 20.7 feet in height, the proposed dwelling will be constructed on the same footprint, but will be 32.24 feet in height where 30 feet is the maximum, thus creating a new nonconformity.  The proposed additions will be 1,281 square feet and the proposed garage will be 351 square feet.  Total proposed building coverage is 3,165 square feet (4%).  The buildable upland is 78,440 square feet.  The lot is in the R40A Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.  The appellant has applied for a Variance under MGL Chapter 40, Section 10 and the Protective Bylaw Sections VIII D.2.c from Appendix II in the alternative.
