LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, November 6, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-073: Thomas J. MacArthur, Trustee, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 91 Rowland Drive, also shown on the Town of Chatham’s Assessors’ Map 13J, Block 12, Lot R11. The appellant seeks to change, alter, or expand a nonconforming dwelling via the construction of an addition to the existing deck 40.2 feet from the Conservancy District where 50 feet is required.  The existing dwelling is nonconforming in that it includes a deck 39.7 feet from the Conservancy District where 50 feet is required.  The building coverage is 2,277 square feet (3.6%) where 10% is the maximum allowed.  The lot is 77,600 square feet where 40,000 square feet is required.  The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw and M.G.L. Chapter 40A Section 6.  

Appeal No. 14-074: Ward Brown, PO Box 603, Chatham, MA  02650, owner of property located at 216 C Orleans Road, North Chatham, MA  02650, also shown on the Town of Chatham’s Assessors’ Map 14H, Block 64, Lot 216C.  Petitioner seeks an Appeals Permit under Section 225-19 of the Town of Chatham Sign Bylaw, to allow the placement of a 11 ½ inch by 92 ½ inch sign.  This sign is proposed to be located on an existing sign backer board located above the door to a commercial condominium unit in the courtyard area of Nickerson Corners, a mixed use commercial condominium complex located in both the SB and R40 Zoning Districts.  This particular unit is located in the R-40 Zoning District.  The proposed sign requires an Appeals Permit under Section 225-10 and Section 225-19 of the Chatham Sign Bylaw.    

Appeal No. 14-076: Jill J. Avery, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 34 Old Salt Works Road, also shown on the Town of Chatham’s Assessors’ Map 13L, Block 2, Lot C31. The appellants seek to change, alter, or extend a nonconforming dwelling on a nonconforming lot via raising a portion of the existing dwelling thereby increasing the ridge height from 23 feet 10 inches to 24 feet 10 inches, 25 feet from the Conservancy District where 50 feet is required.  The existing dwelling is nonconforming in that it is located 9 feet from the Conservancy District where 50 feet is required.  The lot is nonconforming in that it has 104 feet of frontage where 150 feet of frontage is required, and contains 35,820 square feet where 40,000 square feet is required.  The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw and under M.G.L. Chapter 40A Section 6.  

Appeal No. 14-077: Robert and Eileen Forman, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 36 Grist Mill Lane, also shown on the Town of Chatham’s Assessors’ Map 15C, Block 17, Lot H1. The appellants seek to change, alter, or extend a nonconforming dwelling on a nonconforming lot via the addition of a second story. The existing ridge elevation is 20 feet ½ inch and the proposed ridge elevation will be 23 feet 9 inches where 30 feet is the maximum.  The existing dwelling is nonconforming in that it has an abutter’s setback of  20 feet where 25 feet is required.  The lot is nonconforming in that it contains 26,800 square feet where 40,000 is required.   The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw and under M.G.L. Chapter 40A Section 6.
