LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, October 23, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-069: G. Howard Hayes, c/o Julie Tammi, PO Box 2310, Brewster, MA  02631, owner of property located at 210 Orleans Road units A&B, North Chatham, MA  02650, also shown on the Town of Chatham’s Assessors’ Map 14H, Block 64, Lot 210A and Map14H, Block 64, Lot 210B.  Petitioner seeks an Appeals Permit under Section 225-19 of the Sign Code, to allow 4 wall signs for a new real estate office.  The proposed signs are as follows:  120 inches by 24 inches, 62 inches by 13 inches, 140 ½ inches by 12 7/8th inches, and 12 ¾ by 45 ½ for a total of 41.28 square feet of wall signage.  The property is located within two zoning districts, but this particular address is located within the Small Business (SB) Zoning District.  The proposed signage requires an Appeals Permit under Section 225-19 of Chatham’s Sign Code.   

Appeal No. 14-071: Elizabeth Leach, owner of property located at 100 Old Academy Road, also shown on the Town of Chatham’s Assessors’ Map 14F, Block 45, Lot 14. The appellant seeks modify Special Permit No. 13-050 to expand a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling has a road setback of 24.7 feet and the proposed dwelling has a road setback of 24.6 feet where 25 feet is required.  The existing building coverage is 12.4% (1,203 square feet) and the approved building coverage under Special Permit No. 13-050 was 17.3% (1,677 square feet) and the proposed building coverage would be 21.7% (2,099 square feet).  The lot is nonconforming as it contains 10,871 square feet where 20,000 is required.  The Zoning District is R-20.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-072: Richard E. Pinckert, Trustee and Nell N. Pinckert, Trustee, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 20 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16C, Block 5, Lot 74. The appellant seeks to place an exterior mechanical system appliance (generator) 15.2 feet from the road setback where 40 feet is required.  The existing dwelling is nonconforming as it is 19.2 feet from the road setback where 40 feet is required.  The lot is nonconforming as it contains 11,704 square feet where 40,000 is required.  The Zoning District is R-40.  A Variance is required under Section VIII.D.2 c of the Chatham Protective Bylaw.  

Appeal No. 13-054: Habitat for Humanity of Cape Cod, Leedara Zola, Director of Land Acquisition and Permitting, 411 Main St., Suite 6, Yarmouthport, MA 02675, purchaser of property located off Main Street, Chatham. The property is owned by the Chatham Housing Authority and shown on Assessors’ Map 9E, Block 6, lot 2B and in the Barnstable Registry of Deeds Book 28054, Page 121. On January 23, 2014, the appellants received a Comprehensive Permit under M.G.L. Chapter 40B, Sections 20-23 and 760 CMR 56.00, for the construction of four (4) single family dwellings, with a density of approximately one dwelling per half acre, viewing the site as a whole. The appellants received various waivers from regulations promulgated by the Chatham Zoning Bylaw, the Chatham Wetlands Protection Regulation, Chatham Subdivision Regulations, the Chatham Water & Sewer Department, the Chatham Board of Health and other local regulations. The Appellant is now requesting various modifications to the Comprehensive Plan as well as seeking Zoning Board of Appeals review of Home Owner Association documents.  The property contains 90,257 square feet in an SB (Small Business) and R-20 Zoning Districts. A modification to an existing Comprehensive Permit is required under M.G.L. Chapter 40B.

Appeal No. 14-075: Eastward Companies, c/o James M. Norcross, Esq., Po Box 707, Chatham, MA  02633, owner of property located at 20 Dune Drive, also shown on the Town of Chatham’s Assessors’ Map 16A, Block 11, Lot C7. The appellants seek to change, alter, or extend a nonconforming dwelling via the demolition the existing dwelling and construction of a new dwelling with a deck and swimming pool.  The existing dwelling is nonconforming in that it is located entirely within the Coastal Conservancy District where a 50 foot setback is required.  The existing dwelling is also nonconforming as it is 25 feet in height, exceeding the maximum allowable height of 20 feet.  The lot is nonconforming as it contains 27,363 square feet where 40,000 is required and 0 buildable upland where 20,000 square feet is required. The existing building coverage is 2,365 square feet and the proposed building coverage is 2,331 square feet where 2,950 square feet is allowed.   The proposed dwelling ridge height will be 30 feet, thereby exceeding the maximum allowable height of 20 feet in the Coastal Conservancy District.  The proposed structures will meet all other abutter and road required setbacks.  The Zoning District is R-40.  A Special Permit is required under Section V.B., and IV.A.3. of the Chatham Protective Bylaw.
