LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, October 9, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-067: Rene M. and Sharon M. Haas, c/o Susan Ladue, Eastward Companies, 155 Crowell Road, Chatham, MA  02633, owner of property located at 82 Wentworth Lane, also shown on the Town of Chatham’s Assessors’ Map 14K, Block 2, Lot R44. The appellant seeks to change, alter, or expand a nonconforming dwelling to allow one exterior mechanical system to be installed on the northeast corner of the existing dwelling.  The existing dwelling, allowed by Special Permit No. 14-028, is nonconforming as it has a northerly abutter’s setback of 24.9 feet where 25 feet is required.  The existing dwelling contains 3,207 square feet of living area, and has 1,873 square feet of building coverage. The proposed exterior mechanical system (generator) will be 20 feet from the abutter’s setback where 25 feet is required.  The lot is nonconforming in that it contains 20,186 square feet where 40,000 is required.  The Zoning District is R-40.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-068: James & Suzanne Lowry, c/o Alison Alessi Architects, 831 Main Street (Route 6A) Dennis, MA  02638, owner of property located at 29 Homestead Lane, also shown on the Town of Chatham’s Assessors’ Map 16D, Block 3A, Lot 7. The appellant seeks to change, alter, or expand a nonconforming structure via the demolition of the existing dwelling, nonconforming garage, and greenhouse and construction of a new dwelling. The existing garage is 13.7 feet from the easterly abutter’s setback where 15 feet is required.   The existing dwelling and greenhouse comply with setbacks requirements.  The proposed dwelling is 26 feet from the road setback where 25 feet is required and northerly abutters setback of 22 feet where 15 feet is required and easterly abutters setback of 29.5 feet where 15 feet is required.  The existing building coverage is 11% and the proposed building coverage is 14.7% where 15% is the maximum allowed.  The Zoning District is R-20.  A Special Permit is required under M.G.L. Section 6 of Chapter 40A, and Section V of the Chatham Protective Bylaw.  

Appeal No. 14-061: Donna Sedita, c/o Peter S. Farber, PO Box 768, North Chatham, MA  02650, owner of property located at 341 Pleasant Street, also shown on the Town of Chatham’s Assessors’ Map 2A, Block 29, Lot T7A. The appellant seeks to change, alter, or expand a nonconforming dwelling on a nonconforming lot via demolishing the existing dwelling and constructing a new dwelling.  The existing dwelling is nonconforming as it is 1.76 feet setback from the road and the proposed dwelling will be 9.9 feet setback from the road with a front canopy 5.4 feet setback from the road where 25 feet is required.  The existing dwelling is 11.86 feet from the northerly abutter’s setback and the proposed dwelling will be 18.1 feet abutters’ northerly setback where 15 feet is required.  The existing dwelling is 8.97 feet from the easterly abutter’s setback and the proposed dwelling is 6.1 feet from the easterly abutter’s setback where 15 feet is required.  The lot is nonconforming as it contains 9,476 square feet when 20,000 square feet is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  Continued from September 11, 2014.
