LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, March 13, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-007: Michael and Kris Gitlin, 26 Blythewood Road, Baltimore, MD  21210, c/o William G. Litchfield, 330 Orleans Road, North Chatham, MA  02650, owner of property located at 265 Woodland Way, also shown on the Town of Chatham’s Assessors’ Map 11K, Block 8, Lot HC50.   Appellants propose to change, alter, or extend a nonconforming dwelling on a nonconforming lot via the demolition of the existing structure and construction of a replacement dwelling.  The lot is nonconforming in that it has been deemed not to comply with the lot shape requirement of the Protective By-Law; the existing structure encroaches on the required setback from the Conservancy District.  The proposed dwelling will meet the dimensional requirements of the By-Law, but is considered a substantial alteration of a nonconforming single-family dwelling, and under the Second Except Clause of §6 of M.G.L. Ch. 40A, The Zoning Act, such substantial alteration requires the grant of a Special Permit.  The lot contains 53,000 sq. ft. (+/-.)  The Zoning District is R-40.  A Special Permit is required under Section V.B., Non-Conforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective By-Law.

Appeal No. 14-008: Don Broderick, 61 Wequasset Way, Chatham, MA  02633, owner of property located at 61 Wequasset Way, also shown on the Town of Chatham’s Assessors’ Map 71, Block 64, Lot C320.  The appellant proposes to change, alter, or expand a nonconforming single family dwelling via the installation of a generator 14 feet from the easterly abutter setback and air conditioning condensers 15 feet from the easterly abutter’s setback where 25 feet is required.  The lot is nonconforming in that it contains 21,307 square feet where 60,000 square feet is required.   The appellant seeks a Special Permit under Section VII.D.3.g. to locate the mechanical systems within the lot line setback in accordance with the provision of the Protective Bylaw  The property is within the R-60 Zoning District.  The property has the benefit of Special Permit #00-67 to increase the nonconforming nature of the property by the construction of an 8 foot by 14 foot deck which encroached into the abutters setback.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change and Section III. D. 3. g of the Protective Bylaw.  

Appeal No. 14-009: Craig S. Morong, 1366 Outlook Drive West, Mountainside, NJ  07092, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 270 Stage Island Road, also shown on the Town of Chatham’s Assessors’ Map 13A2, Block 32, Lot D166. The appellant proposes to expand a nonconforming single family dwelling via the construction of four additions with a total of approximately 853 square feet.   The building is nonconforming as it is 37.5 feet from the Conservancy District where 50 feet is required.  The existing building coverage is 3,408 square feet (9.9%) and the proposed coverage will be 4,261 square feet (12.4%) where a maximum of 10% is allowed, creating a new nonconformity.   The lot has 34,383 square feet of buildable upland where 20,000 square feet is required.  The Zoning District is R-40.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-010: Page L. van Amson, Trustee, Page L. van Amson 2012 Revocable Trust, 66 Stevens Road, Needham, MA  02492, owner of property located at 58 Horseshoe Lane, also shown on the Town of Chatham’s Assessors’ Map 10D, Block 8, Lot S8.  The appellant proposes to change, alter, or expand a nonconforming single family dwelling via the construction of a garage 46 feet (+/-) from the Coastal Conservancy District where 50 feet is required and the construction of an exterior mechanical system (pump for hot tub) 13 feet from the westerly lot line where 50 feet is required.  The existing structure is nonconforming in that it is located 33 feet from the top of a Coastal Bank where 50 feet is required.  In addition, the Appellant seeks a Special Permit under Section IV.A.3.a. to validate previously constructed steps and an observation deck within the Conservancy District.  The lot contains 43,522 square feet.  The Zoning District is R20.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change and Section III. D. 2.b., as to the construction of the observation deck within a Conservancy District, of the Protective Bylaw.  

Appeal No. 14-011: On Shore at Last, LLC, 104 Crowell Road, Chatham, MA  02633, c/o Michael D. Ford, PO Box 485, West Harwich, MA  02671, owner of property located at 157 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16D, Block 33, Lot 40. The appellant proposes to change, alter, or expand a nonconforming structure with attached garage by demolishing the existing structure and reconstructing a single family dwelling, detached garage with a one bedroom guestroom,  and pool.  The existing structure is nonconforming in that the northern abutter’s setback is 16.8 feet and the southern abutter’s setback is 21.5 feet where 25 feet is required.  The lot is nonconforming in that it has 136.3 feet frontage where 150 feet is required.  The Appellant seeks to raze and rebuild a new five bedroom dwelling which will have a foot print of 4,391 square feet, and proposed garage with one bedroom which will have a footprint of 1,080 square feet, and will result in total building coverage of 5,471 square feet or 9.7% where 10% is allowed.  The proposed structure will conform to setback requirements.  The property is within the R-40 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 13-092: Sally Wightman Trust of 1990, c/o William G. Litchfield, 330 Orleans Road, North Chatham, MA  02650, owner of property located at 132 Old Salt Works Road, Chatham, MA  02633, also shown on the Town of Chatham’s Assessors’ Map 13M, Block 10, Lot C23, submitted on behalf of Kenneth Stoll, agreed vendee, c/o William F. Riley, 154 Crowell Road, Box 707, Chatham, MA  02633. The appellant proposes to change a nonconforming single family dwelling on a nonconforming lot via the demolition of an existing dwelling and construction of a new dwelling.  The lot is nonconforming as it has 29,670 square feet where 40,000 square feet is required. The dwelling is nonconforming as it is located within the Conservancy District.  The Appellant proposes to remove the existing dwelling and construct a new dwelling in compliance with proposed FEMA regulations.  The proposed structure will be nonconforming in that the road setback will be 29.2 feet where 40 feet is required and will also be located within the Conservancy District.  The proposed building coverage will be 3,330 square feet where 3,000 square feet is allowed, creating a new conformity.  The property is located in an R-40 Zoning District.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw. Continued from February 27, 2014.
