LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, January 23, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 13-090: Jean H. Kindleberger, 19 Prentis Street, Cambridge, MA  02140, c/o William G. Litchfield, Esq., 330 Orleans Road, N. Chatham, MA 02650, owner of property located at 66 Patterson Road, South Chatham, MA, also shown on the Town of Chatham’s Assessors’ Map 6B, Block 21G, Lot 66. The appellant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via the construction of a 168 square foot addition located 21.5 feet from the street where 25 feet is required, and which will increase the coverage from 974 square feet, (14.4%) to 1,142 square feet (16.9%) where a maximum of 15% is allowed, creating a new nonconformity.  The existing structure is nonconforming in that it is located 20.8 feet from the street where 25 feet is required.  The lot is nonconforming in that it contains 6,742 square feet where 20,000 square feet is required.  The property is within the R-20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 13-091: Peter C. and Ann T. McKay, 3 Hoeffler Avenue, Medfield, MA  02052, c/o William F. Riley, 154 Crowell Road, Box 707, Chatham, MA 02633, owner of property located at 120 Nantucket Drive, Chatham, MA, also shown on the Town of Chatham’s Assessors’ Map 6C, Block 72, Lot G107. The appellant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via the construction of garage under an existing deck with a pergola above on the north side as well as a dormer and second floor deck over an existing porch roof on the south side of the home.  The garage under the existing deck will be 20 feet from the Conservancy District where 50 feet is required.  The existing building coverage is 12.5%.  The proposed coverage is 15.3% where a maximum of 15% is allowed, creating a new nonconformity.  Lot is nonconforming in that it contains 18,509 square feet, 15,768 square feet of upland where 20,000 square feet is required for a lot and not less than 20,000 square feet of upland.  The property is within the R-20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 13-092: Sally Wightman Trust of 1990, c/o William G. Litchfield, 330 Orleans Road, North Chatham, MA  02650, owner of property located at 132 Old Salt Works Road, Chatham, MA  02633, also shown on the Town of Chatham’s Assessors’ Map 13M, Block 10, Lot C23, submitted on behalf of Kenneth Stoll, agreed vendee, c/o William F. Riley, 154 Crowell Road, Box 707, Chatham, MA  02633. The appellant proposes to change a nonconforming single family dwelling on a nonconforming lot via the demolition of an existing dwelling and construction of a new dwelling.  The lot is nonconforming as it has 29,670 square feet where 40,000 square feet is required. The dwelling is nonconforming as it is located within the Conservancy District.  The Appellant proposes to remove the existing dwelling and construct a new dwelling in compliance with proposed FEMA regulations.  The proposed structure will be nonconforming in that the road setback will be 29.2 feet where 40 feet is required and will also be located within the Conservancy District.  The proposed building coverage will be 3,330 square feet where 3,000 square feet is allowed, creating a new conformity.  The property is located in an R-40 Zoning District.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 13-093: John F. White, Trustee, John F. White Living Trust, 11574 Algonquin, Pinckney, MI  48169, c/o William G. Litchfield, Esq., 330 Orleans Road, N. Chatham, MA 02650 owner of property located at 19 Uncle Levi’s Lane, South Chatham, also shown on the Town of Chatham’s Assessors’ Map 2A, Block 20, Lot E8. The appellant proposes to change, alter, or expand a nonconforming single family dwelling on a nonconforming lot via the construction of an addition to the northerly side.  The proposed addition will comply with the dimensional requirements of the Protective Bylaw, but is considered a substantial alteration to a nonconforming single family dwelling, and under the Second Except Clause of Section VI of M.G.L. Ch. 40A, The Zoning Act, such substantial alteration requires the grant of a Special Permit.  The existing structure is nonconforming in that it is located 9 feet from the lot line where 15 feet is required. The lot is nonconforming in that it contains 17,650 square feet where 20,000 square feet is required. The Zoning District is R20.   A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.
