LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, September 8, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-062: Michael and Amy Quinn, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 140 Kelley Lane, also shown on the Town of Chatham’s Assessors’ Map 11D Block 14 Lot D4.  The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the demolition of the existing dwelling and nonconforming shed and the construction of a new dwelling.  The existing shed is nonconforming in that it has an abutters setback of 10 feet where 15 feet is required.  The proposed dwelling will meet all bulk and dimensional requirements of the bylaw, but is considered an intensification on a nonconforming lot which requires the grant of a Special Permit.  The existing building coverage is 1,150 square feet (10.07%) and the proposed building coverage is 1,704 square feet (14.95%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 11,411 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 16-065: Dan Bergquist and Sarah Upton-Bergquist, PO Box 461, Chatham, MA  02633, owner of property located at 48 Crowell Road, also shown on the Town of Chatham’s Assessors’ Map 13F Block 31 Lot W7.  The Applicant seeks to enlarge, extend, or change a nonconforming structure via the construction of a front porch 34.12 feet from the road.  The existing structure is nonconforming in that it is located 42.06 feet from the road where a 50 foot setback is required in the GB3 Zoning District.  The lot contains 15,413 square feet in the GB3 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. and of the Chatham Protective Bylaw.

Application No. 16-063: Robert, Daniel and Paul Byrnes, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owners of the property located at 147 Lime Hill Road, also shown on the Town of Chatham’s Assessors’ Map 12E Block 19 Lot B2.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the construction of additions and expansion of existing garage under.  The existing dwelling is nonconforming in that it has a southerly abutters setback of 23.3 feet and an easterly abutters setback of 17.7 feet where 25 feet is required.  The proposed addition to the northeast will be nonconforming in that the will be 20.8 feet from the easterly abutters setback where 25 feet is required.  The proposed addition to the southeast will be nonconforming in that the will be 16.7 feet from the easterly abutters setback and 16 feet from the southerly abutters setback where 25 feet is required. The existing building coverage is 1,648 square feet (11.7%) and the proposed building coverage is 2,002 square feet (14.2%) where 15% is the maximum allowed.  The lot is nonconforming in that it has 120 feet of frontage where 150 feet is required and contains 14,130 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 16-066: Cannon Hill Investment Properties, LLC,  c/o William G. Litchfield Esq., 330 Orleans Road, North Chatham, MA  02650,  owner of property located at 325 Whidah Road, also shown on the Town of Chatham’s Assessors’ Map 13K Block 7 Lot W10.  The Applicant seeks to enlarge, extend, or change a nonconformity via the installation of exterior mechanical system appliances (air conditioning condensers) 12 feet from the northerly lot line and 5 feet from the southerly lot line where 25 feet is required.  The lot is nonconforming in that there is a well house 12 feet from the northerly lot line and an exterior mechanical system appliance (generator) 3 feet from the southerly lot line where 25 feet is required.  The lot contains 40,340 square feet where 40,000 square feet is required in the R-40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B. of the Protective Bylaw.   

Application No. 16-064: 302 Seapine, LLC,  c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA  02671, owner of property located at 302-304 Seapine Road,  also shown on the Town of Chatham’s Assessors’ Map 12K Block 10 Lot HC29.  The Applicant seeks to enlarge, extend, or change a pre-existing nonconforming boathouse with bedroom on a nonconforming lot via the demolition of the existing boathouse and construction of a new boathouse with one bedroom.  The existing boathouse is nonconforming in that it is located entirely within the Coastal Conservancy District (Flood Plain el. 11) and was constructed prior to the requirement for a special permit for a boathouse in the Coastal Conservancy District.  The proposed boathouse will continue to be nonconforming as it will be located within the Conservancy District and contains a bedroom.  The existing and proposed building coverage will remain 3,864 square feet (6%) where 10% is the maximum allowed.  The lot is nonconforming as to lot shape at 149.5 feet where 150 feet is required. The lot contains 68,111 square feet where 40,000 square feet is required in an R40 Zoning District.  A Special Permit is required under MGL Chapter 40A Section 6 and Section V.B., of the Chatham Protective Bylaw.
