LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, September 22, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-067: Andrew J. and Marjorie J. Farquharson Revocable Trust, c/o Richard Avery, PO Box 2416, Mashpee, MA  02649, owner of property located at 34 Eileen Road, also shown on the Town of Chatham’s Assessors’ Map 6D Block 15 Lot G35.  The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the construction of an addition and construction of porches.  The proposed addition and porches will meet all dimensional requirements of the bylaw, but is considered an intensification on a nonconforming lot which requires the grant of a Special Permit.  The existing building coverage is 1,122 square feet (8.7%) and the proposed building coverage is 1,608 square feet (12.4%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 12,939 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 16-068: Edward C Eldridge Family Trust, c/o David Lyttle, PO Box 439, South Orleans, MA  02662, owner of property located at 78 Pine Knoll Avenue, also shown on the Town of Chatham’s Assessors’ Map 6C Block 102 Lot S27.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition and deck.  The proposed addition and deck will meet all dimensional requirements of the bylaw, but is considered an intensification on a nonconforming lot which requires the grant of a Special Permit.  The existing building coverage is 840 square feet (9.5%) and the proposed building coverage is 1,321 square feet (15%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 8,808 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 16-069: Cape Water Street Trust, c/o Mark Zibrat, 63 Crowell Road, Chatham, MA  02633, owner of property located at 133 Water Street, also shown on the Town of Chatham’s Assessors’ Map 17B Block 1 Lot 48.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the extension of the second floor by the construction of a dormer 2.12 feet the northerly abutters setback.  The existing dwelling is nonconforming on that it is located 2.12 feet from the northerly abutters setback where a 15 foot setback is required.  The existing building coverage is 3,503 square feet (31%) and the proposed building coverage is 3,555 square feet (31.5%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 11,300 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 16-070: David and Wendy Gruenberg, c/o Jim Gronski, PO Box 167, West Chatham, MA  02669, owner of property located at 58 Pine Grove Road, also shown on the Town of Chatham’s Assessors’ Map 8B Block 14 Lot H28.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition.  Also proposed is the removal an existing storage shed.  The proposed addition will meet all dimensional requirements of the bylaw, but is considered an intensification on a nonconforming lot which requires the grant of a Special Permit.  The existing dwelling is nonconforming on that it is located 14.8 feet from the southerly abutters setback where a 15 foot setback is required.  The existing building coverage is 1,258 square feet (10.5%) and the proposed building coverage is 1,733 square feet (14.4%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 12,000 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 16-071: Steven and Lisa Knoop, c/o Dan Becotte, 744 Harwich Road, Brewster, MA  02631, owner of property located at 41 Earles Way, also shown on the Town of Chatham’s Assessors’ Map 12G Block 47 Lot M14.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of an existing deck and construction of an addition 25 feet from the northerly abutter.  The proposed addition will meet all dimensional requirements of the bylaw, but is considered an intensification on a nonconforming lot which requires the grant of a Special Permit.  The existing building coverage is 1,008 square feet (5.7%) and the proposed building coverage is 1,536 square feet (8.8%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 17,390 square feet where 60,000 square feet is required in the R60 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 16-058: Bradford and Victoria Spencer, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at 104 Old Salt Works Road, also shown on the Town of Chatham’s Assessors’ Map 13M, Block 7, Lot C26. The Applicant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via the demolition of the existing dwelling and swimming pool and construction of a new dwelling and swimming pool.  The existing dwelling is nonconforming in that it is located 29 feet from the road where 40 feet is required.   The existing pool is nonconforming in that it is located 21.1 feet from the easterly abutter where 25 feet is required.  The existing dwelling is nonconforming in that it is located wholly within the Coastal Conservancy District where a 50 foot setback is required. The pre-existing nonconforming generator will be relocated to be 22 feet easterly abutter where 25 feet is required.  The proposed dwelling is nonconforming in that it will be located 29 feet from the road where 40 feet is required.  The proposed swimming pool is nonconforming in that it will be located 19.8 feet from the easterly abutter where 25 feet is required.  The existing building coverage is 3,526 square feet and the proposed is 3,089 square feet where 2,800 square feet is the maximum allowed. The lot is nonconforming in that it contains 98.5 feet of frontage where 150 feet is required; 685 square feet of buildable upland where 20,000 square feet is required and contains 32,200 square feet where 40,000 square feet is required in an R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section VB of the Chatham Protective Bylaw.  Continued from August 25, 2016.
