LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, February 26, 2015, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-002: Paul Julien, Trustee, 39 Sheridan Road, Wellesley, MA  02481, c/o William F. Riley, Esq., 154 Crowell Road, Box 707, Chatham, MA 02633, owner of property located at 138 Mooncussers Lane, Chatham, MA, also shown on the Town of Chatham’s Assessors’ Map 10A, Block 3, Lot H1.  The appellant proposes to install two exterior mechanical system appliances (air conditioning unit and generator) 22 feet from the road setback where 40 feet is required.  The approved dwelling and garage, by Special Permit 14-09 and 14-044, will be 30 feet from the Coastal Conservancy District where 50 feet is required.  The approved out-building will meet setback requirements.  The approved building coverage is 5,621 square feet (10%) where 10% is allowed.  The approved dwelling is setback from the road 25.3 feet where 40 feet is required.  The lot is 103,500 square feet where 40,000 square feet is required and located in the R40 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw

Application No. 15-003: Robert and Michelle Goodnow, c/o William F. Riley, Esq.,  PO Box 707, Chatham, MA  02633, owners of property located at 4 Marion Lane, also shown on the Town of Chatham’s Assessors’ Map 14H Block 30 Lot G1.  The appellant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is 33.5 feet setback from the road (Stony Hill Road) and the proposed dwelling will be nonconforming in that it will be 26 feet setback from the road where 40 feet is required.  The existing dwelling is also nonconforming in that it has a road setback (Marion Lane) of 29.7 feet and the proposed dwelling will be 30.1 feet where 40 feet is required.  The existing building coverage is 898 square feet (8.5%) and the proposed building coverage is 1,300 square feet (12.3%) where 15% is the maximum, but not more than 2,800 square feet.  The lot is nonconforming in that it contains 10,555 square feet where 40,000 square feet is required.  The lot is located within the R-40 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-004: Mimi Jigarjian, Highland Realty Trust, c/o George Reilly, Land Design Associates, 63 Brook Trail Road, Brewster, MA  02631, owner of property located at 309 Stage Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 14C Block 47 Lot 31.  The appellant seeks to enlarge, extend, or change a nonconforming guest unit on a nonconforming lot via the construction of a dormer on the second story within the abutter’s setback.  The existing guest unit is nonconforming in that it has a southerly abutter’s setback of 2.7 feet where 25 is required.  The lot is nonconforming in that it contains a main dwelling and a guest unit on a 31,465 square foot lot where a minimum of 40,000 square feet plus 20,000 square feet for the guest unit is required.  The lot is located within the R-40 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  


Application No. 14-089: Ann B. and Gordon H. Woodward, c/o Michael D. Ford, PO Box 485, West Harwich, MA  02671, owners of property located at 34 Sears Point, also shown on the Town of Chatham’s Assessors’ Map 11A, Block 5, Lot 10B. The Appellants seek to construct a 199 square foot boathouse, 65 square foot deck and stairs, and 59 square foot ramp within the Coastal Conservancy District.  The proposed boathouse is located 91 feet from an Inland Conservancy District where 25 feet is required.  The proposed boathouse has a road setback of 525 feet where 40 feet is required and a westerly abutter’s setback of 33.7 feet and an easterly abutter’s setback of 53.8 feet where 25 feet is required.  The proposed boathouse will be 17.8 feet in height where 20 feet is the maximum height allowed within the Conservancy District. Existing building coverage is 1,375 square feet; the proposed building coverage is 1,574 square feet where 3,000 is the maximum allowed.  The Appellant seeks to create an unpaved path approximately 30’ in length from the proposed boathouse to the beach located within the Coastal Conservancy District.  The lot contains 80,300 square feet with 29,900 square feet of upland, and is located within the R-40 Zoning District.  A Special Permit is required under Section VIII D.2.b and Section IV A. 3. of the Chatham Protective Bylaw.  Continued from January 8, 2015.
