LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, January 26, 2017, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-099: Willard and Bonnie Daggett,  c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA 02671, owner of property located at 80 Quasson Road, also shown on the Town of Chatham’s Assessors’ Map 17D Block 13 Lot F15.  The applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is 35.2 feet from the Coastal Conservancy District where 50 feet is required.  The existing dwelling is also nonconforming in that it has a southerly abutter’s setback of 21 feet and a northerly abutter’s setback of 19.9 feet where 25 feet is required. The existing building coverage is 3,350 square feet where 2,900 square feet is the maximum allowed.  The proposed dwelling will comply with the all bulk and dimensional requirements. Also proposed is the installation of two exterior mechanical system appliances (generator and air conditioning compressor) 24.4 feet from the southerly abutter’s setback where 25 feet is required.  The lot is nonconforming in that it contains 119 feet of frontage where 150 feet is required and contains 23,500 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under Section V.B. and Section III.D.3.g. of the Chatham Protective Bylaw.  

Application No. 16-100: John and Kathleen Drew,  c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 38 Cove Hill Road,  also shown on the Town of Chatham’s Assessors’ Map 12J Block 30 Lot G161.  The Applicant seeks to enlarge, extend, or change an existing boathouse approved under Special Permit No. 80-77 on a conforming lot via the replacement of the existing boathouse foundation, construction of a roof deck and construction of an elevated walkway connecting the proposed roof deck to an existing stairway.  The lot contains 54,406 square feet where 40,000 square feet is required in an R40 Zoning District.  A Special Permit is required under Section IV.A.3 and Section VIII.D.2.b of the Chatham Protective Bylaw.  

Application No. 16-101: Kevin and Hope Foley, c/o Sarah Turano-Flores, Esq., PO Box 1630, Hyannis, MA 02601, owners of property located at 127 Old Salt Works Road, also shown on the Town of Chatham’s Assessors’ Map 13M Block 18 Lot C37. The Applicant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via the demolition of the existing dwelling and garage and construction of a new dwelling, garage and swimming pool. The existing structures are nonconforming in that they are located wholly within the Coastal Conservancy District where a 50 foot setback is required.  The existing dwelling is nonconforming in that it is located 24.1 feet from the road where 40 feet is required.   The existing garage is nonconforming in that it is located 26.2 feet from the road where 40 feet is required.  The proposed dwelling, garage and swimming pool will conform to road and abutter setback requirements but will continue to be nonconforming as to the Coastal Conservancy District setback.  The existing building coverage is 2,891 square feet and the proposed is 2,889 square feet where 2,800 square feet is the maximum allowed. The lot is nonconforming in that it contains no buildable upland where 20,000 square feet is required and contains 21,441 square feet where 40,000 square feet is required in an R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Sections IV.A.6.d and V.B. of the Chatham Protective Bylaw.

Application No. 16-091: CBI 20 45 Chatham Bars Avenue LLC, c/o Matthew Kozol, Esq., 31 St. James Avenue, Suite 925, Boston, MA  02116, appealed the issuance of a Cease and Desist order of the Building Commissioner, issued on October 13, 2016 for the property located at 45 Chatham Bars Avenue, also shown on the Town of Chatham Assessors Map 15D Block 39 Lot C16.  The applicant seeks to have the Building Commissioner’s Cease and Desist Order reversed.  The property contains 34,848 square feet in an R20 Zoning District.  The Applicant appealed under Section VIII.D.2.a. Administration, Powers, Appeals, of the Town of Chatham Protective Bylaw and M.G.L Chapter 40A, Sections 8 & 15. Continued from December 15, 2016.
