The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, February 25, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-002: Joanne B. Bauer and Timothy L. Painter, c/o William G. Litchfield, 330 Orleans Road, North Chatham, MA  02650, owners of the property located at 165 Taylor’s Pond Road, also shown on the Town of Chatham’s Assessors’ Map 4C Block 58 Lot T8.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the construction of a 6 foot by 22 foot addition to the existing garage.  The existing dwelling is nonconforming in that it is located 9.5 feet from the top of the Coastal Bank where 50 feet is required in the Conservancy District.  The existing building coverage is 2,219 square feet (16.9%) and the proposed building coverage is 2,351 square feet (18%) where 15% is the maximum allowed.  The lot is nonconforming in that the lot contains 18,800 square feet and 13,095 square feet of buildable upland where 20,000 square feet is required.  The lot is located within the R20 zoning district.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.  

Application No. 16-004: Robert MacDonald c/o Jamie McGrath, Pine Harbor Wood Products, 259 Queen Anne Road, Harwich, MA  02645, owner of property located at 11 Shattuck Place, also shown on the Town of Chatham’s Assessors’ Map 15D, Block 98, Lot X2. The Applicant proposes to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the installation of an 8 foot by 12 foot shed.  The existing lot is nonconforming in that it contains 65.5 feet of frontage where 100 feet is required and contains two dwellings on insufficient lot size.  The existing dwelling at 11 Shattuck Place is nonconforming in that the road setback is 21.5 feet where 25 feet is required and northerly abutters setback of 8.8 feet where 15 feet is required.  The proposed shed will also be nonconforming in that it will be 6 feet from the northerly abutter’s setback where 15 feet is required.  The existing building coverage is 3,144 (13.9%) and the proposed building coverage is 3,336 square feet (14.7%) which exceeds the maximum building coverage of 2,900 square feet.  The existing lot contains 22,640 square feet where 20,000 square feet is required.  The lot is in the R20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Application No. 16-005: Kevin and Pam O’Brien, c/o Jack McElhinney, Esq., 63 Shore Road, Suite 23, Winchester, MA 01890, owners of property located at 400 Cedar Street, are appealing the Building Commissioner’s issuance of a Building Permit for 398 Cedar Street, owned by Benjamin K. and Heather L. Morgan, also shown on the Town of Chatham’s Assessors’ Map 11B, Block 16, Lot 12. The Applicants are appealing the issuance of a building permit as aggrieved parties under M.G.L. c. 40A, Section 8 and Section VIII D. 2.a. of the Chatham Protective Bylaw.  

Application No. 15-087: Mark and Jane Johnson, c/o Jim Hagerty, Reef Realty, 24 School Street, P.O. Box 186, West Dennis, MA  02670, owners of property located at 28 Pine Drive, also shown on the Town of Chatham’s Assessors’ Map 6C Block 50 Lot J10.    The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that its road setback is 21.1 feet where 25 feet is required.  The proposed dwelling will also be nonconforming in that its road setback is 23.5 feet where 25 feet is required.  The existing building coverage is 863 square feet (12.5%) and the proposed building coverage is 1,034 square feet (14.98%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 6,900 square feet where 20,000 square feet is required in the R-20 Zoning District.  A Special Permit is required under Section V.B. and Section V.III.D.2.b. of the Chatham Protective Bylaw.  Continued from January 14, 2016.

Application No. 15-095: 76 Barcliff Avenue, LLC, c/o William F. Riley, Esq., 156 Crowell Road, Box 707, Chatham, MA  02633, owner of property located at 76 Barcliff Avenue, also shown on the Town of Chatham’s Assessors’ Map 15G Block 13 Lot 31.    The Applicant proposes to change, alter or expand nonconforming dwellings on a conforming lot via the demolition of two (2) existing dwellings and construction of two (2) dwellings.  The existing use is nonconforming in that two (2) dwellings on one lot is considered a preexisting nonconforming use as both dwellings were constructed prior to the adoption of the Chatham Protective Bylaw and are eligible to be changed, altered, or extended pursuant to Section V.B.  One of the existing dwellings is nonconforming as it has a road setback of 33.6 feet where 40 feet is required.  Both of the proposed dwellings will meet all dimensional setbacks.  The existing building coverage is 2,581 (5.9%) square feet and the proposed building coverage is 4,284 square feet (9.9%) where 10% is the maximum allowed.  The lot contains 43,180 square feet in the R-40 Zoning District.      A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B. of the Protective Bylaw.  Continued from February 11, 2016.
