Application No. 21-033: Aunt Deborah’s Lane Condominium Trust, Brian W. Smith, Trustee, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 28 Aunt Deborah’s Lane, also shown on the Town of Chatham’s Assessors’ Map 2B Block 65 Lot X28.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The proposed dwelling will comply with road and abutter setback requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The lot is nonconforming in that it contains four dwellings where only one dwelling is allowed.  The existing building coverage is 724 square feet and the proposed building coverage is 878 square feet.  The total building coverage, if approved, will be 3,212 square feet where 2,900 square feet is the maximum allowed.  The lot contains 24,450 square feet in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 21-034: Aunt Deborah’s Lane Condominium Trust, John M. Bruno, Trustee, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 36 Aunt Deborah’s Lane, also shown on the Town of Chatham’s Assessors’ Map 2B Block 65 Lot X36.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 5.7 feet from the southerly abutter where a 15 foot setback is required.  The proposed dwelling will comply with road and abutter setback requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The lot is nonconforming in that it contains four dwellings where only one dwelling is allowed.  The existing building coverage is 672 square feet and the proposed building coverage is 874 square feet.  The total building coverage, if approved, will be 3,260 square feet where 2,900 square feet is the maximum allowed.  The lot contains 24,450 square feet in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 21-035: Andrew T. and Rachel E. Fay, c/o Timothy Smith, 1281 Main Street, Chatham, MA, 02633, owners of property located at 63 Andrew Mitchell Lane, also shown on the Town of Chatham’s Assessors’ Map 14I Block 50 Lot W58. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a conforming lot via the construction of additions and an increase in ridge height within the westerly abutters setback where a 25 foot setback is required.  The existing building coverage is 2,947 square feet (6.6%) and the proposed building coverage is 4,041 square feet (9.1%) where 10% is the maximum allowed.  The lot contains 44,366 square feet in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw. 

Application No. 21-036: Woodland Way Nominee Trust, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 237 Woodland Way, also shown on the Town of Chatham’s Assessors’ Map 11K Block 7 Lot HC48.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling, pool house and swimming pool and construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 24 feet from the westerly abutter, the existing pool house is nonconforming in the it is located 17.4 feet from the easterly abutter where a 25 foot setback is required.  The existing pool is nonconforming in that it is located 15.1 feet from the easterly abutter where a 25 foot setback is required and is located within the 50 foot setback to the Coastal Conservancy District.  The proposed dwelling will comply with all bulk and dimensional requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The existing building coverage is 2,087 square feet (4.1%) and the proposed building coverage is 5,068 square feet (10%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains 140 feet of frontage where 150 feet is required. The lot contains 71,300 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 21-037: Woodland Way Nominee Trust, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 263 Woodland Way, also shown on the Town of Chatham’s Assessors’ Map 11K Block 7 Lot HC49.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and construction of a new dwelling, guest house and swimming pool.  The existing dwelling is nonconforming in that it is located 14 feet from the Coastal Conservancy District.  The proposed dwelling and guest house will comply with all bulk and dimensional requirements of the Bylaw but are considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The proposed swimming pool will be nonconforming in that it will be located 30 feet from the Coastal Conservancy District where a 50 foot setback is required.  The existing building coverage is 2,175 square feet (4.3%) and the proposed building coverage is 3,831 square feet (7.6%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains 140 feet of frontage where 150 feet is required. The lot contains 67,172 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 21-038: Chester and Colleen Johnson, c/o Patricia Hopkins, 4 Blue Heron Landing, Harwich MA 02645, owners of the property located at 2624 Main Street, also shown on the Town of Chatham’s Assessors’ Map 3D Block 42 Lot 9A.  The Applicants seek an Appeals Permit under Section 225-19 of the Town of Chatham Sign Bylaw, to allow the placement of a 24 inch by 60 inch (10 square foot) wall sign.  The lot contains 32,661 square feet in a R20 Zoning District.  The proposed sign requires an Appeals Permit under Section 225-19 of the Chatham Sign Bylaw.
