Application No. 21-061: David and Michele McManus, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owners of property located at 24 Ivy Lane, also shown on the Town of Chatham’s Assessors’ Map 16B Block 41 Lot 31A.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition and dormers.  The existing dwelling is nonconforming in that it is located 10.7 feet from the westerly abutter and 8.6 feet from the northerly abutter.  The proposed addition will be nonconforming in that it will be located 13.6 feet from the northerly abutter and 18.8 feet from the westerly abutter where a 15 foot setback is required.  The existing building coverage is 1,278 square feet (19.5%) and the proposed building coverage is 1,478 square feet (22.5%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 6,562 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.  The Applicants representative has requested a withdrawal without prejudice.

Application No. 20-081: Katama Point LLC, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 68 Shell Drive, also shown on the Town of Chatham’s Assessors’ Map 14K Block 7 Lot W50.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the relocation of a portion of the existing dwelling and conversion into a guest quarters and the construction of a new dwelling and swimming pool.  Also proposed is the installation of a new driveway as allowed by Special Permit under Section IV.A.3.d.  The existing dwelling is nonconforming in that it is located entirely within the Coastal Conservancy District (Flood Plain ele. 11).  The proposed guest quarters and new dwelling will be nonconforming in that they will be located within the Coastal Conservancy District where a 50 foot setback is required.   The existing building coverage is 3,697 square feet (43.7%) and the proposed building coverage is 7,635 square feet (90.3%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 8,455 square feet of contiguous building upland where 20,000 square feet is required for a single dwelling.  The lot contains 120,100 square feet in the R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Chatham Protective Bylaw. Continued from December 17, 2020, January 28, 2021, March 11, 2021, April 22, 2021 and June 24, 2021.

Application No. 21-060: Anne A. Randle Trust of 1998, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 17 Silver Leaf Avenue, also shown on the Town of Chatham’s Assessors’ Map 16B Block 28 Lot 71. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing garage and the construction of an addition.  Also proposed is the reconstruction of the existing deck and outdoor shower.  The existing dwelling is nonconforming in that it is located 14.7 feet from the northerly abutter.  The existing garage is nonconforming in that it is located 2.6 feet from the northerly abutter and 1.8 feet from the westerly abutter.  The proposed addition will be nonconforming in that it will be located 2.5 feet from the northerly abutter and 1.9 feet from the westerly abutter.  The proposed deck will remain nonconforming located 0.1 feet from the westerly abutter where a 25 foot setback is required.  The outdoor shower will become conforming as it will be located entirely on the subject property.  The existing building coverage is 1,585 square feet (23.3%) and the proposed building coverage is 1,691 square feet 24.8%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 6,817 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw. 

Application No. 21-062: Oyster Pond Trust, c/o Michael D. Ford, Esq., PO Box 485, West Harwich MA 02671, owner of property located at 23 Oyster Pond Lane, also shown on the Town of Chatham’s Assessors’ Map 13E Block 9 Lot JB1.  The Applicant seeks to construct elevated stairs and landings as allowed by Special Permit under Section IV.A.3.a. of the Protective Bylaw.  The lot contains 99,300 square feet in the R60 Zoning District. A Special Permit is required under M.G.L Chapter 40A Section 9 and Section VIII.D.2.b. of the Chatham Protective Bylaw.

Application No. 21-063: Joseph J. and Anne M. Nunes, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 85 Seaview Street, also shown on the Town of Chatham’s Assessors’ Map 15E Block 22A Lot 22A. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the partial demolition of the existing dwelling and the construction of an addition and deck.  Also proposed is the installation of exterior mechanical system appliances (A/C condenser and generator).  The existing dwelling is nonconforming in that it is located 14.2 feet from the road where a 25 foot setback is required, 6 feet from the westerly abutter and 2.6 feet from the easterly abutter.  The proposed addition and deck will be nonconforming in that it will be located 2.6 feet from the easterly abutter and 4.8 feet from the westerly abutter where a 15 foot setback is required.  The proposed exterior mechanical system appliances will be nonconforming located 5 feet from the easterly abutter where a 15 foot setback is required.  The existing building coverage is 1,060 square feet (12.7%) and the proposed building coverage is 1,160 square feet (13.9%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 8,356 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw. 

Application No. 21-067: Nathaniel and Nancy Boughton, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 8 Gramps Way, also shown on the Town of Chatham’s Assessors’ Map 2C Block 62 Lot 15A. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition.  The Applicant proposes to construct an addition that will comply with the abutters setback requirements.  The existing building coverage is 2,055 square feet (20.5%) and the proposed building coverage is 2,145 square feet (21.4%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 10,019 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.
