The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, December 14, 2017, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 17-097: Lewis and Emilie Chang, c/o Richard Roy, 123A Queen Anne Road, Harwich, MA  02645, owner of property located at 281 Ridgevale Road, also shown on the Town of Chatham’s Assessors’ Map 6C Block 27 Lot 8C.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing three season porch and construction of a two story addition.  Also proposed is the construction of a deck. The existing dwelling is nonconforming in that it is located 6 feet from the Ridgevale Road and 2.1 feet over the property line with Bog Way.  The proposed addition will be nonconforming in that it will be located 6 feet from Ridgevale Road and 0 feet from the Bog Way where 25 feet is required.  The proposed deck will be nonconforming in that it will be located 6 feet from Ridgevale Road where 25 feet is required.  The existing building coverage is 788 square feet (23.9%) and the proposed building coverage is 760 square feet (23%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 3,330 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 17-104: A & A Building and Remodeling Inc., owner of the property located at 2570 Main Street, also shown on the Town of Chatham’s Assessors’ Map 3D Block 48 Lot 19.  The Applicants seeks an Appeals Permit under Section 225-19 of the Town of Chatham Sign Bylaw, to allow the placement of a 30 inch by 40 inch (8.3 square foot) ground sign and a 30 inch by 20 inch (4.16 square foot) wall sign for a nonconforming business in the R20 Zoning District.  The proposed signs require an Appeals Permit under Section 225-19 of the Chatham Sign Bylaw.    

Application No. 17-107: Robert Stevens and Ellen Briggs, owners of the property located at 72 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16D Block 21 Lot B12.  The Applicant seeks a Variance under Section VIII.D.2.c. from the requirements of Appendix II, to allow for a structure which exceeds the 30 foot height restriction.  The height of the windmill structure being moved to the site is 31.9 feet.  The lot contains 37,377 square feet in the R40 Zoning District.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.     

Application No. 17-108: James and Jane Carr, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 31 Aunt Carrie’s Road, also shown on the Town of Chatham’s Assessors’ Map 3B Block 21 Lot B23.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 13.1 feet from the westerly abutter where 25 feet is required.  The proposed dwelling will comply with all bulk and dimensional requirements of the Bylaw.  The existing building coverage is 930 square feet (12.91%) and the proposed building coverage is 1,079 square feet (14.98%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 7,200 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 17-110: Robert and Elizabeth Potter, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 391 Stage Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 14B Block 18 Lot 4.  The Applicant seeks to enlarge, extend, or change nonconforming dwellings and accessory structures on a nonconforming lot via the demolition of the main dwelling, one cottage and garage and construction of a new dwelling cottage and garage.  The existing main dwelling is nonconforming in that it is located 19.7 feet from the road and is located 4.3 feet from the southerly abutter.  The existing cottage is nonconforming in that it is located 24.3 feet from the easterly abutter.  The existing garage is nonconforming in that it is located 24.6 feet from the road.  The second existing cottage, which will remain unchanged, is nonconforming in that it is located .9 feet from the southerly abutter where 25 feet is required.  The proposed main dwelling will be nonconforming in that it will be setback 26.3 feet from the road where 40 feet is required and 7.6 feet from the southerly abutter where 25 feet is required. The proposed cottage will conform to setback requirements.  The proposed garage will be nonconforming in that it will be located 36 feet from the road where 40 feet is required.  The existing building coverage is 2,554 square feet and the proposed building coverage is 2,950 square feet where 2,950 square feet is the maximum allowed.  The lot is nonconforming in that it contains three dwellings where one is allowed, and contains 26,117 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Other Business:
Vote to authorize Town Counsel to execute the Agreement between parties for 398 Cedar Street (Land Court Docket No. 15 MISC 000534)
