	LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, September 12, 2013,  starting at 4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

The ZBA will discuss the matter of arranging for technical assistance for a Comprehensive Permit application scheduled for a future date.


Appeal No. 13-050:  Elizabeth F. Leach, 21 Hawthorne Place, Apt. 12E, Boston, MA  02114, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owner of property located at 100 Old Academy Road, also shown on Assessors’ Book Page 14F as Lot 14.  The appellant proposes to expand a nonconforming single family dwelling via the partial demolition of an existing dwelling and the reconstruction and enlargement of a portion of the existing structure and the addition of a garage on the westerly side, 22.7 feet from the road where a 25 foot setback is required.  The building coverage will increase from 12.4% (1,203 sq. ft.) to 17.3% (1,677 sq. ft.) where  a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 22.7 feet from the road where a 25 foot setback is located, and the lot is nonconforming in that it contains 9,657 sq. ft. where 20,000 sq. ft. is required. The Zoning District is R-20.    A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-051:  Ian & Joanne MacDonald, 67 Potash Road, Mansfield, MA  02048, owners of property located at 55 George Ryder Road, also shown on Assessors’ Book Page 8E as Lot 18.  The appellants propose to expand a nonconforming single family dwelling via the demolition of an existing dwelling and construction of a new dwelling.  The proposed new dwelling is in compliance with road and abutter setback requirements, however, the  building coverage will increase from an existing 6.7% (784 sq. ft.) to 20% (2,304 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 6.1 feet from the northerly lot line where a 15 foot setback is required.  The lot is nonconforming in that it contains 11,662 sq. ft. where 20,000 sq. ft. is required, and 0.0 linear ft. of frontage where 100 ft. is required.   The Zoning District is R-20.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-053:  John J. & Gabriella Masko, 18 Georgianna Drive, Cumberland, RI  02864, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 25 Courtnell Road, also shown on Assessors’ Book Page 15G as Lot C7.  The appellants propose to expand a nonconforming single family dwelling via the demolition of an existing nonconforming single family dwelling and construction of a new single family dwelling, 21.9 feet from the road where a 40 foot setback is required.  The existing dwelling is nonconforming in that it is located 25.3 feet from the road where a 40 foot setback is required.  The lot is nonconforming in that it contains 24,319 sq. ft. where 40,000 sq. ft. is required. The Zoning District is R-40.     A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-055:  Howard & Lisa Van Vleck, 11 Shady Hill Square, Cambridge, MA  02136, c/o Daniel A. Sylver, 17 Pond View Avenue, Chatham, MA  02633, owners of property located at 594 Old Harbor Road, also shown on Assessors’ Book Page 16H as Lot 7A.  The appellants propose to alter and relocate a nonconforming boathouse in a Coastal Conservancy District (Flood Plain, A9 Zone, el. 12), 8.2 feet from the northeasterly lot line where a 25 foot setback is required.  The existing boathouse is nonconforming in that it is located 1.6 feet from the northeasterly lot line where a 25 foot setback is required.  The property contains 54,149 sq. ft. in an R-40 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, of the Protective Bylaw.
