LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, November 7, 2013, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 13-047: GRS Investments, LLC, 1455 Main St., Chatham, MA 02633, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA 02633, owners of property located at Lot ND3 Misty Meadow Lane, also shown on Town of Chatham Assessors’ Map 13H, Block 3, Lot ND3.  The appellants are requesting the grant of a Dimensional Variance to construct a multi-family structure containing 3 two bedroom dwelling units, 25.6 feet from a Coastal Conservancy District (Flood Plain, el. 11) where a 50 foot setback is required.  Multi-family structures are an allowed use with the grant of a special permit by the Planning Board in an R-20A Zoning District.  A Dimensional Variance is required under Appendix II, Schedule of Dimensional Requirements and Section VIII.D.2.c, Zoning Board of Appeals, Powers, Variances, of the Protective Bylaw.  The property contains 69,129 square feet total with 32,500 square feet of buildable upland in an R-20A Zoning District. 

Appeal No. 13-067: George Herzlinger, 560 Concord Avenue, Belmont, MA 02478, c/o Minglewood Homes, Inc., 1281 Main Street, Chatham, MA 02633, owners of property located at 108 Shore Road, also shown on the Town of Chatham Assessors’ Map 16D, Block 19, Lot 26.  The appellants propose to expand a nonconforming single family dwelling via the addition of a generator 20 feet from the easterly lot line where a 25 foot setback is required.  The property is nonconforming in that it contains a main dwelling and a guest house on 59,429 square feet where 60,000 square feet is required.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings, and Uses, Enlargement, Extension or Change, of the Protective Bylaw.  Request for Continuance to December 5, 2013.

Appeal No. 13-068: Barry & Laurie Nagler, 303 County Lane, Needham, MA 02492 c/o William G. Litchfield, Esq, 330 Orleans Road, No. Chatham, MA 02650 owners of property located at 60 Harbor Hill, also shown on the Town of Chatham Assessor’s Map 11B, Block 21D, Lot C10.  The appellants propose to expand a nonconforming single family dwelling via the addition of a covered porch on the westerly side of the existing dwelling, 24.7 feet from the lot line where a 25 foot setback is required and the construction of an addition on the easterly side of the dwelling 21.1 feet from the lot line where a 25 foot setback is required.  The existing dwelling is nonconforming in that it is located 21.6 feet from the southerly lot line and 24 feet from the northerly lot line where 25 foot is required.  The lot contains 40,500 square feet where 40,000 square feet is required.  The Zoning District is R-40.  A Special Permit is required under Section V.B., Non-Conforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw. 

Appeal No. 13-069: David M. Horsfall & Laura Horsfall, 43 Margery Lane, Westwood, MA 19095, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA 02650 owners of property located at 10 Patterson Road, also shown on the Town of Chatham Assessor’s Map 6C, Block 39, Lot G74.  The appellants propose to expand a nonconforming dwelling on a nonconforming lot via the construction of a 16’ X 18’ covered porch.  The proposed addition will meet setback requirements but which will increase the existing nonconforming building coverage from 1,160 square feet, or 21.5% of the lot area, to 1,454 square feet, or 26.9%, where 15% is allowed.  The existing dwelling is nonconforming in that it is 10.2 feet from the lot line where 15 feet is required.  The lot is nonconforming in that it contains 5,400 square feet where 20,000 square feet is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B., Non-Conforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.  

Appeal No. 13-058:  Nickerson Corners MJM, LLC, c/o Michael Mullaney, Manager, 375 Great Western Road, owner of property located at 210 Orleans Road, also shown on the Town of Chatham Assessors’ Map 14H, Block 64, Lot R16.  Continued from September 26, 2013.
