The swimming pool is proposed to be located 25.5 feet from the road where a 40 foot setback is required. The property contains 21,928 square feet within the R40 Zoning District. A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw. The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the removal of the second floor and the construction of a new second floor, an addition and a storage shed. The Applicant proposes to incorporate an overnight Kennel use to the existing Personal and Household Service use (dog care and training facility with retail component) which requires the grant of a Special Permit.
