Note:  Due to a typographical error in posting on the town website the time for this meeting could not be corrected although the public notice was appropriately published as a Legal Notice.  This agenda is for the 9-11-23 ZBA Hearing re Gouin’s Appeal
(Held in the Library’s Ramdsdell Room at 6 pm)

2.	Approval or amending the agenda
3.	Situating the purpose of this meeting within the ZBA’s functions
4.	The pre-2018 §125-21(A) bylaw1
5.	The 2023 §125-21(A) amended bylaw, especially the first two sentences2
6.	The 11/22/2020 and 7/2/23/2023 letters from the Zoning Enforcement officer to Mr. Gouin
7.	The appeal:  Mr. Gouin and his attorney David Mintz will explain their appeal
8.	Focusing questions for the hearing:
a.	Which fixtures in place before April 2023 violate the pre-2018 version of the §125-21(A) bylaw?
b.	Which fixtures have been added after the April notice of the bylaw violate either version of the bylaw?
c.	Are there any fixtures that have been added, changed, altered, or extended after the April notice that conform to the 2023 version?
d.	For any of the previously non-conforming fixture that have been changed, altered, or extended after the April notice, were there any applications to the ZBA for a finding under the §125-7(E) bylaw?

1“Lighting.  Any outdoor lighting fixture shall be shielded so that it does not produce strong, direct light beyond the property boundaries.” 
2“Applicability. The requirements of this section shall apply to all outdoor lighting on all lots and parcels in any district in the Town of Pelham. When existing outdoor lighting equipment is being modified, extended, expanded or replaced, it shall be subject to the requirements of this section.”
