LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, November 17, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-086: Janet Killmon, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owners of property located at 21 Hammond Lane, also shown on the Town of Chatham’s Assessors’ Map 16B Block 46 Lot 34. The Applicant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via the addition of dormers and a second floor deck.  The existing dwelling is nonconforming in that it is located 4.7 feet from the westerly abutter and 12.1 feet from the easterly abutter where 15 feet is required from both.  The existing and proposed building coverage is 1,242 square feet (24.6%) where 15% is the maximum allowed. The lot is nonconforming in that it contains 5,056 square feet where 20,000 square feet is required in an R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section VB of the Chatham Protective Bylaw.

Application No. 16-087: Endless Summer LLC, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owners of property located at 26 Stage Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 14D Block 9 Lot M6. The Applicant proposes to demolish a nonconforming dwelling on a nonconforming lot and construct a new dwelling. The existing dwelling is nonconforming in that it is setback 9.5 feet from the northerly abutter and 17.3 feet from the southerly abutter where 25 feet is required from both. The proposed dwelling will be setback 12.1 feet from the northerly abutter where 25 feet is required.  Also proposed is the installation of an exterior mechanical system appliance (generator) 17.4 feet from the southerly abutter where 25 feet is required.  The existing building coverage is 2,575 square feet (15.1%) and the proposed building coverage is 2,949 square feet (17.3%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 17,060 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B. of the Protective Bylaw.     

Application No. 16-088: Laurie and Robert Fitzpatrick, 9 Pellet Lane, South Chatham, MA  02659, owners of property located at 9 Pellet Lane, also shown on the Town of Chatham’s Assessors’ Map 2A Block 51 Lot 50. The Applicant proposes to complete the construction of an addition as approved under Special Permit No. 02-12.  The existing dwelling is nonconforming in that it is setback 15 feet from the road where 25 feet is required; is located 8.9 feet from the easterly abutter and 10.7 feet from the westerly abutter where 15 feet is required from both. The proposed addition will be placed on the existing foundation which is setback 10.7 feet from the westerly abutter where 15 feet is required.  The existing building coverage is 18.6% and the proposed building coverage is 22% where 15% is the maximum allowed.  The lot is nonconforming in that it contains 6,069 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B. of the Protective Bylaw.     

Application No. 16-089: Robert and Kathryn Lewis, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of the property located at 335 Cedar Street, also shown on the Town of Chatham’s Assessors’ Map 12B Block 2 Lot 17.  The Applicants seek to construct a new detached garage with conditioned space 31.3 feet from the road where 40 feet is required.  The existing building coverage is 1,440 square feet (6.3%) and the proposed building coverage is 2,384 square feet (10.5%) where 15% is the maximum allowed.  The lot contains 25,499 square feet where 40,000 square feet is required in the R40 Zoning District.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw. Or in the alternative, the Applicants seek to construct a new permanent covered walkway and garage with conditioned space 31.3 feet from the road where 40 feet is required.  The existing dwelling is nonconforming in that it has a road setback of 28.1 feet where 40 feet is required.  The existing building coverage is 1,440 square feet (6.3%) and the proposed building coverage is 2,684 square feet (11.8%) where 15% is the maximum allowed.  The lot contains 25,499 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B. of the Protective Bylaw.
