LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, June 28, 2018, starting at 3:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 18-052: Douglas and Jane Kelly, c/o Frank Shealey, Esq., PO Box 666, Chatham, MA 02633,owners of property located at 310 Cockle Cove Road, are appealing the Building Commissioner’s issuance of a Building Permit for 314 Cockle Cove Road, owned by the Scott and Charna Daly, also shown on the Town of Chatham’s Assessors’ Map 5C Block 21 Lot 4. The Applicants are appealing the issuance of a building permit (No. 18-368) for the construction of a three bedroom single family dwelling as aggrieved parties under M.G.L. Chapter 40A Section 8 and Section VIII.D.2.a. of the Chatham Protective Bylaw.  

Application No. 18-033: Kevin and Kristyne Brownlie, c/o Richard Roy, 123A Queen Anne Road, Harwich, MA 02645, owner of property located at 48 Marsh View Road, also shown on the Town of Chatham’s Assessors’ Map 8C Block 14 Lot S75.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of additions.  The existing dwelling is nonconforming as to building coverage and Coastal Conservancy District setbacks.  The proposed additions will be nonconforming in that they will be located within the Coastal Conservancy District setback (Flood Plain ele. 11).  The existing building coverage is 1,031 square feet and the proposed building coverage is 1,682 square feet where 2,800 square feet is the maximum allowed.  The lot is nonconforming in that it contains 920 square feet of buildable upland and 12,000 square feet of land area where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B of the Chatham Protective Bylaw.  Continued from May 24, 2018.

Application No. 16-076: The Chatfield Company, Inc., c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA  02671, owners of property located at 373-375 Bridge Street, also shown on the Town of Chatham’s Assessors’ Map 16B Block 25 Lot 22.  The Applicant seeks to extend Special Permit No. 16-076 for two years.  The current expiration date is October 27, 2018, and the proposed expiration date is October 29, 2020.  Special Permit No. 16-076 allowed the Applicants demolish the existing principal dwelling (375 Bridge Street) and the construct a new principal dwelling and swimming pool.  The existing dwelling is nonconforming in that it has an easterly abutters setback of 19 feet where 25 feet is required.  The proposed dwelling will be nonconforming in that the easterly abutter setback will be 20 feet where 25 feet is required.  The proposed dwelling and swimming pool will meet all other bulk and dimensional requirements of the bylaw.  The existing building coverage is 3,806 square feet (7.9%) and the proposed building coverage is 4,837 square feet (10%) where 10% is the maximum allowed.  The lot is conforming in that it contains 1.54 acres where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 14 and Section VIII.D.2.b. of the Protective Bylaw.  

Application No. 18-045: FOJ Family Partners, LLC, c/o J. Thaddeus Eldredge, 1038 Main Street, Chatham, MA 02633, owner of property located at 51 Old Queen Anne Road, also shown on the Town of Chatham’s Assessors’ Map 12F Block 11 Lot 11.  The Applicants seek to construct a permanent elevated catwalk and at grade steps over the Inland Bank.  The total lot size is 92,400 square feet and the property is located within the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 9 and Sections IV.A.3.a. and VIII.D.2.b. of the Chatham Protective Bylaw. 

Application No. 18-051: Eastward MBT LLC, owner of the property located at 185 Queen Anne Road, also shown on the Town of Chatham’s Assessors’ Map 14E Block 17 Lot 2.  The Applicant seeks to modify Special Permit No. 18-006 granted on April 26, 2018, to modify Condition No. 3 to allow for site work and landscaping to take place.  This condition required that no construction would be allowed between June 22nd and September 10, 2018. The lot contains 14,772 square feet in a GB2/R40 Zoning District.   A Special Permit is required under M.G.L. Chapter 40A Section 14 and Section VIII.D.2.b. of the Chatham Protective Bylaw.
