LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, July 12, 2018, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 18-044: Robert N. Sanders, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 46 Tobey Turtle Road, also shown on the Town of Chatham’s Assessors’ Map 6B Block 39 Lot G90.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the elevation of the existing dwelling to allow for the construction of a new foundation and an expanded foundation with a deck above.  The existing dwelling is nonconforming in that it is located 8.9 feet from the westerly abutter, 19.2 feet from Tobey Turtle Road, 19 feet from Bay View Road, and within the 50 foot setback from the Coastal Conservancy District. The proposed dwelling will be nonconforming in that it will be located 8.9 feet from the westerly abutter where 15 feet is required, 19.2 feet from Tobey Turtle Road where 25 feet is required and will remain within the 50 foot setback from the Coastal Conservancy District.  The proposed deck will be nonconforming in that it will be 16.6 feet from Bay View Road where a 25 foot setback is required.  The existing building coverage is 1,192 square feet (19.6%) and the proposed building coverage is 1,304 square feet (21.4%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 6,608 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.   

Application No. 18-047: Ann B. Reece QPRT, c/o William R. Riley, Esq., PO Box 707, Chatham, MA 02633, owners of property located at 284 Kendrick Road, also shown on the Town of Chatham’s Assessors’ Map 14K Block 9 Lot 7.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the elevation of the existing dwelling, demolition of the existing garage and construction of a new garage with second floor habitable space and a deck connecting the two structures.  The structures are and will remain nonconforming as they are located entirely within the Coastal Conservancy District (Flood Plain ele. 13) where a 50 foot setback is required.  The elevated dwelling and reconstructed garage will comply with all other bulk and dimensional requirements of the Bylaw.  The existing and proposed building coverage is 2,579 square feet where 2,800 square feet is the maximum allowed.  The lot is nonconforming in that it contains 0 square feet of buildable upland where 20,000 square feet is required and is conforming in that it contains 2.4 acres where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.  

Application No. 18-048: Henry and Leslie Crosby, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 35 Shattuck Place, also shown on the Town of Chatham’s Assessors’ Map 15D Block 101 Lot 75.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of additions (porch and partial second floor).  The existing dwelling is nonconforming in that it is located 7.3 feet from the northerly abutter.  The proposed porch will be nonconforming in that it will be setback 7.3 feet from the northerly abutter and proposed second floor addition will be nonconforming in that it will be located 9 feet from the northerly abutter where 15 feet is required.  The existing building coverage is 1,522 square feet (5.3%) and the proposed building coverage is 1,933 square feet (6.7%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains 91.85 feet of frontage where 100 feet is required but is conforming in that it contains 28,980 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 18-049: A Great Yarn LLC, c/o Ron Weishaar, owner of property located at 894 Main Street, also shown on the Town of Chatham’s Assessors’ Map 13F Block 76 Lot X3.  The Applicant seeks to enlarge, extend, or change a nonconforming structure on a conforming lot via the construction of an addition and exterior stairway.  The existing structure is nonconforming in that it is setback 11.4 feet from the road. The proposed addition will be nonconforming in that it will be 36 feet from the road where 50 feet is required. The existing lot coverage is 58.1% and the proposed lot coverage is 58.3% where 60% is the maximum allowed.  The lot is conforming in that it contains 2.98 acres where 10,000 square feet is required in the GB3 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 & 9 and Sections V.B. & VIII.D.2.b. of the Protective Bylaw.  Under Application No. 18-056, the Applicant seeks a Dimensional Variance from the required 50 foot road setback to allow for the construction of the addition and stairway as described above.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.           

Application No. 18-050: Bernard and Mary O’Connor, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 127 Hitching Post Road, also shown on the Town of Chatham’s Assessors’ Map 14F Block 21 Lot ME16.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of a 64 square foot shed.  The proposed shed will comply with the road and abutter setback requirements.  The existing building coverage is 1,146 square feet (15.4%) and the proposed building coverage is 1,210 square feet (16.3%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 7,443 square feet where 20,000 square feet is required in an R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section VB of the Chatham Protective Bylaw.

Application No. 18-039: Lisa and Timothy Barrett, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA 02671, owner of property located at 209 Shore Road Unit 1, also shown on the Town of Chatham’s Assessors’ Map 16E Block 18 Lot X1.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of a portion of the existing dwelling connecting units 1 and 2 and the construction of additions on unit 1.  The existing structure is nonconforming in that it is located 35.7 feet from Shore Road and 12.1 feet from Chatham Bars Avenue.  Once separated into two structures Unit 2 will remain nonconforming as to the road setback.  The proposed addition to Unit 1 will be nonconforming in that it will be located 23 feet from the road where a 40 foot setback is required.  The existing total building coverage is 3,811 square feet (10.9%) and the proposed building coverage is 3,923 square feet (11.2%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains three dwelling units where only one is allowed and contains 34,904 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.   Continued from June 14, 2018.
