LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, June 12, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-036: Clay and Elizabeth Gilmore, 29 Pinewood Drive, Brewster, MA  02631, c/o T. Stephen Smith, PO Box 616, South Chatham, MA  02659, owner of property located at 43 Tobey Turtle Road, also shown on the Town of Chatham’s Assessors’ Map 3B, Block 34, Lot B36. The appellant proposes to demolish the existing dwelling and construct a new dwelling.  The existing and proposed dwelling are nonconforming in that its easterly abutter’s setback is and will remain 11.7 feet where 15 feet is required.  The existing building coverage is 1,118 square feet (16%) and the proposed building coverage is 1,446 square feet (20.6%) where 15% is allowed.  The lot is nonconforming in that it contains 7,000 square feet where 20,000 is required.  The lot is also nonconforming in that it contains 70 feet of frontage where 100 feet is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-037: Robert Michael, LLC, 10 Seacrest Village, Chatham, MA  02633, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 59 Seaview Street, also shown on the Town of Chatham’s Assessors’ Map 15E, Block 9, Lot 18. The appellant proposes to demolish three existing structures and construct two new dwellings.  The existing use is nonconforming in that it contains multiple dwellings where one is allowed.  One existing dwelling is nonconforming in that it has setbacks of 24.4 feet from the road where 25 feet is required.  The existing building coverage is 2,303 square feet (10.1%), the proposed building coverage is 3,413 square feet (15%) where the maximum allowed is 2,900 square feet thereby creating a new nonconformity. The proposed dwellings will meet the setback requirements of the Zoning District.  The Zoning District is R-20.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-011: On Shore at Last, LLC, 104 Crowell Road, Chatham, MA  02633, c/o Michael D. Ford, PO Box 485, West Harwich, MA  02671, owner of property located at 157 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16D, Block 33, Lot 40. The appellant proposes to change, alter, or expand a nonconforming structure with attached garage by demolishing the existing structure and reconstructing a single family dwelling, detached garage with a one bedroom guestroom, and pool.  The existing structure is nonconforming in that the northern abutter’s setback is 16.8 feet and the southern abutter’s setback is 21.5 feet where 25 feet is required.  The lot is nonconforming in that it has 136.3 feet frontage where 150 feet is required.  The Appellant seeks to raze and rebuild a new five bedroom dwelling which will have a foot print of 4,391 square feet, and proposed garage with one bedroom which will have a footprint of 1,080 square feet, and will result in total building coverage of 5,471 square feet or 9.7% where 10% is allowed.  The proposed structure will conform to setback requirements.  The property is within the R-40 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw. Continued from April 24, 2014.
