LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, July 23, 2015, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-036: Heather Damon, owner of property located at 29 Norma Lane, also shown on the Town of Chatham’s Assessors’ Map 4F Block 23B Lot JY3.  The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the construction of an addition (Guest House) and deck on the westerly side of the dwelling.  The existing southerly setback is 53.2 feet and the proposed southerly setback is 25.5 feet where 25 feet is required.  The existing westerly abutter’s setback is 68.1 feet and the proposed westerly abutter’s setback is 36.8 feet where 25 feet is required.  The existing building coverage is 1,536 square feet (5.1%) and the proposed building coverage is 2,311 square feet (7.7%) where 10% is the maximum allowed.   The lot is nonconforming in that it contains 66.20 feet of frontage where 150 feet of frontage and contains 30,131 square feet where 60,000 square feet is required in the R-60 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  The Applicant is also seeking a waiver as allowed under Section VII.B.12.D. of the required additional land area requirement under Section VII. B. 12. C.

Application No. 15-037: Glacier Point, LLC, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 29 Stage Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 14D Block 12A Lot 12A.  The Applicant seeks to enlarge, extend, or change a nonconforming use and structure via the conversion of a portion of the existing office space to residential use and thereby create a second apartment unit converting the use to multifamily.  The existing use, apartment incidental to a Commercial Use, is nonconforming in that Section VII.B.4.a.1 of the Bylaw requires 10,000 square feet per apartment whereas the lot contains 9,880 square feet.  .  The lot is located within the GB-1 zoning district and is otherwise conforming, containing 9,880 square feet where 5,000 square feet is required.  A Special Permit is required under Appendix I, Schedule of Use Regulations, Multifamily Dwelling, of the Protective Bylaw. 

Application No. 14-079: Eileen M. Segerson, Trustee, c/o Hayes, Messina, Gilman & Hayes, LLC, 200 State Street, 6th Floor, Boston, MA  02109, owner of property located at 0 Wilfred Road, also shown on the Town of Chatham’s Assessors’ Map 11G, Block 27, Lot B2. The applicant seeks to construct a nonconforming dwelling on a nonconforming lot.  The proposed dwelling is 5 feet 4 inches from the road setback where 25 feet is required, but will comply with the abutter’s setback and Inland Conservancy setback.  The proposed deck is 22 feet from the Conservancy District where 25 feet is required.  Proposed building coverage is 1,408 square feet (17.2%) where 2,900 square feet is the maximum allowed.  The lot contains 22,380 square feet and has 327 feet of frontage, but is nonconforming due to the lot’s dimensions, however the lot meets the requirements of Section V.D.1 of the Protective Bylaw as the lot was created in 1961, complied with zoning requirements at that time, was provided with public water, had sufficient frontage and was greater than 5,000 square feet.  The Zoning District is R-20.  A Variance is required under Section V.III.D.2.c of the Protective Bylaw.  Continued from May 28, 2015.

Application No. 15-031: Janet Gove Dugan, Trustee, Janet Gove Dugan Trust, c/o Andrew Singer, Esq., 26 Upper County Road, P. O. Box 67, Dennisport, MA 02639, owner of property located at 0 and 16 Little Beach Road, also shown on the Town of Chatham’s Assessors’ Map 16A Block 35 Lot H41A and Lot H40A.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is wholly within the Coastal Conservancy District where 50 feet is required.  The existing dwelling is also nonconforming in that it has a road setback of 35.9 feet where 40 feet is required, a westerly abutter’s setback of 24.8 feet where 25 feet is required, a southerly abutter’s setback of 14 feet where 25 feet is required, and a ridge height of 20.03 feet where 20 feet is the maximum.  The original lot is nonconforming in that it contains 6,049 square feet where 40,000 square feet is required and contains 0 square feet of buildable upland where 20,000 square feet is required but the lot will become less nonconforming when the vacant abutting lot (Lot 40A) is added to the existing lot. The proposed dwelling will have a road setback of 33 feet (covered front stoop) where 40 feet is required, a westerly abutter’s setback of 16 feet where 25 feet is required and the ridge height will be 29 feet where 20 feet is the maximum allowed.   The two lots combined will be 10,705 square feet where 40,000 square feet is required within the R-40 Zoning District.  A Special Permit is required under Sections IV and V.B., of the Chatham Protective Bylaw and M.G.L. Chapter 40A, Section 6.  Continued from June 25, 2015.

Application No. 15-029: KAHR Holdings, LLC, c/o Peter Polhemus, Polhemus Savery DaSilva, 101 Depot Road, Chatham, MA  02633, owner of the property located at 1 Isaac Hardy Lane, also shown on the Town of Chatham’s Assessors’ Map 16D Block 60 Lot 1.  The Applicant seeks to amend Special Permit No. 06-008 Condition No. 4 to allow the removal of two large willow trees and replace them with seven large caliper trees.  The property contains 23,485 square feet and is located in the GB2 and R20 Zoning Districts.  M.G.L. Chapter 40A, Section 14 authorizes the Zoning Board of Appeals to make orders or decisions, reverse or affirm in whole or in part, or modify any order or decision.  Continued from June 25, 2015.
