LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, April 28, 2016, starting at 3:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-019: Scot and Gail Butcher, c/o Rick Roy, Rick Roy Construction, 123A Queen Anne Road, Harwich, MA  02645, owners of the property located at 72 Windward Passage, also shown on the Town of Chatham’s Assessors’ Map 15I Block 39 Lot B6.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the construction of dormers.  Also proposed is a conforming addition and dormer at the rear of the dwelling, which the Zoning Enforcement Officer has determined does not increase the nonconforming nature of such dwelling.  The existing dwelling is nonconforming in that it has a road setback of 33.2 feet where 40 feet is required and the southerly abutter’s setback of 23.3 feet where 25 feet is required.  The proposed front dormer will have a road setback of 35 feet where 40 feet is required.  The existing building coverage is 2,353 square feet (10.3%) and the proposed building coverage is 2,573 square feet (11.2%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 22,930 square feet where 40,000 square feet is required in the R-40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw for the front dormer.  

Application No. 16-021: Bruce and Theresa Reed, c/o William G. Litchfield, 330 Orleans Road, North Chatham, MA  02650, owners of the property located at 17 Bog Way Road, also shown on the Town of Chatham’s Assessors’ Map 16C Block 22 Lot G10.  The Applicant seeks to change, alter or extend a nonconforming dwelling on a nonconforming lot via the construction of a 14 foot by 11.16 foot addition on the south side, a 14 foot by 8 foot addition on the northeast side and two 10.5 foot by 1.3 foot overhangs on the east side of the existing structure, all within 50 feet of the Coastal Conservancy District.  Also proposed is the reconstruction of an existing deck on the west side of the structure which will conform to the abutters’ setback.  The proposed addition will be constructed 27 feet from the existing Coastal Conservancy District setback where 50 feet is required, and 14 feet from that proposed under a zoning amendment Article to be considered at the May 2016 Annual Town Meeting where 50 feet would be required; other additions are also within the existing and proposed Coastal Conservancy District setbacks.  The existing dwelling is nonconforming in that it is setback 32 feet from the Coastal Conservancy District and 18 feet from the proposed Coastal Conservancy District setback where 50 feet is required.  The dwelling is nonconforming in that it contains a deck 14.9 feet from the north sideline setback where 15 feet is required.    The existing building coverage is 965 square feet (10.8%) and the proposed building coverage is 1,276 square feet (14.2%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 8,980 square feet of buildable upland where 20,000 square feet is required and contains 11,207 square feet where 20,000 square feet is required in an R-20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.  

Application No. 16-023: Paul Mackoul and Natalyn Danilyants, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA  02671, owners of property located at 180 Stage Island Road, also shown on the Town of Chatham’s Assessors’ Map 14A1, Block 1, Lot D23. The Applicant proposes to change, alter or extend a pre-existing nonconforming single family dwelling via the construction of second floor dormers, a deck expansion and stairs. The existing deck is setback 8.6 feet and the proposed deck will be setback 5 feet from the Conservancy District where 50 feet is required. The Applicant also proposes to change, alter, or expand a nonconforming use on a nonconforming lot via the installation of 40 foot elevated catwalk to the existing stairs located wholly within the Conservancy District.   The existing dwelling is nonconforming in that its building coverage is 2,782 square feet (17.07%) where 15% is the maximum allowed.  The existing lot is nonconforming in that it contains 30,545 square feet where 40,000 square feet is required and 15,710 square feet of buildable upland where 20,000 square feet is required in the R-40 Zoning District.  All other bulk and dimensional regulations are conforming.  A Special Permit is required under Section V.B and Section IV.A.3 of the Chatham Protective Bylaw.

Application No. 16-024: Paul Mackoul and Natalyn Danilyants, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA  02671, owners of property located at 180 Stage Island Road, also shown on the Town of Chatham’s Assessors’ Map 14A1, Block 1, Lot D23. The Applicant proposes to change, alter, or expand a nonconforming use on a nonconforming lot via the installation of 40 foot by 40 inch elevated catwalk with two handrails located wholly within the Conservancy District, where a 36 inch width with one handrail are allowed.   The property contains 3,545 square feet in an R-40 Zoning District.  A Dimensional Variance is required under Section IV.A.6.e. and Section VIII.D.2.c. of the Chatham Protective Bylaw.

Application No. 16-025: Paul Picknelly, c/o Polhemus Savery DaSilva, 157 Brewster Chatham Road, Harwich, MA  02645, owners of property located at 14 Champlain Road, also shown on the Town of Chatham’s Assessors’ Map 13A, Block 33, Lot 12. The Applicant proposes to change, alter, or expand a nonconforming dwelling (deck) on a nonconforming lot via a 3 foot expansion to the west, 18.7 feet from the westerly abutters setback and a 4 foot expansion to the north of the existing deck, 1.8 feet from the Coastal Conservancy District.  The existing rear deck is nonconforming in that it is located 22.3 feet from the westerly abutters setback and 5.3 feet from the Coastal Conservancy District where 50 feet is required.   Also proposed is the expansion of the front deck by removing the existing two front stairs and replacement with decking, 23.7 feet from the road, where 40 feet is required.  The property contains 14,157 square feet in an R-40 Zoning District.  A Special Permit is required under Section VB of the Chatham Protective Bylaw.

Application No. 16-026: Fatface, c/o Brian Perlow, 51 Sleeper Street, Floor 6, Boston, MA  02210, lessees of property located at 470 Main Street, also shown on the Town of Chatham’s Assessors’ Map 15D, Block 48, Lot 89. The Applicant proposes to establish and operate a Formula Business (retail clothing) under Section III.C.4.c of the Protective Bylaw.  The Applicant is and proposes to do business as a retail clothing store, which utilizes a standard array of merchandise, logo, layout, symbol and signage utilized by ten or more other businesses worldwide.  The store will include 969 square feet of retail space.  There are no changes proposed to the existing structure, and the signs have been approved by the Historic Business District Commission. The property contains 15,150 square feet in a GB2 Zoning District.  A Special Permit is required under Section III.C.4.c. and Section VIII.D.2.b. of the Chatham Protective Bylaw.
