Application No. 20-001: Timothy C. Emerson Revocable Trust, c/o James M. Norcross, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 305 Main Street and 15 School Street, also shown on the Town of Chatham’s Assessors’ Map 16C Block 60 Lot 33.  The Applicant seeks to enlarge, extend, or change nonconforming dwellings on a nonconforming lot via the demolition of the rear portion of the existing dwelling (305 Main Street) and the construction of additions.  The existing dwelling is nonconforming in that it is located 20.8 feet from Main Street and 7 feet from the Coastal Conservancy District (Flood Plain ele. 11).  The proposed additions to the dwelling at 305 Main Street will be nonconforming in that they will be located 18.2 feet from the road where a 25 foot setback is required and 11 feet from the Coastal Conservancy District where a 50 foot setback is required.  The existing dwelling (15 School Street) which will remain unchanged is nonconforming in that it is located 10.2 feet from School Street and 8.1 feet from the southerly abutter.  The unnumbered dwelling (proposed to be demolished and reconstructed in a different location under a separate application, No. 20-002) located behind 15 School Street is nonconforming in that it is located 12.7 feet from the southerly abutter and within the Coastal Conservancy District.  Also proposed is the construction of a new driveway as allowed by Special Permit under Section IV.A.3.d. of the Bylaw.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Chatham Protective Bylaw.  Continued from January 23, 2020 and continuance requested from March 26, 2020. 

Application No. 20-010: Tacoma Partners Limited Partnership, c/o Thadd Eldredge, 1038 Main Street, Chatham, MA 02633, owner of property located at 543 Old Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 16H Block 2 Lot 3.  The Applicant seeks to construct a pool with deck, pool fence and split rail fence within the Conservancy District.  The proposed deck and fencing are allowed by Special Permit under Section IV.A.3.a. of the Protective Bylaw.  The lot contains 91,825 square feet in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 9 and Section VIII.D.2.b. of the Chatham Protective Bylaw.   Scheduled for March 26, 2020.

Application No. 20-011: Skorpios Enterprises Inc, c/o Philip Malitas, owner of the property located at 1077 Main Street, also shown on the Town of Chatham’s Assessors’ Map 12F Block 2 Lot 2.  The Applicants seek an Appeals Permit under Section 225-19 of the Town of Chatham Sign Bylaw, to allow the placement of a 12 inch by 70 inch (5.83 square feet) ladder board to the existing ground sign.  The proposed total square footage of the ground sign is 25.76 square feet.  The lot contains 27,907 square feet in a R20 Zoning District.  The proposed sign requires an Appeals Permit under Section 225-19 of the Chatham Sign Bylaw.   Scheduled for March 26, 2020.

Application No. 20-012: Laurie A. Galop Trust, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 232 Shane Drive, also shown on the Town of Chatham’s Assessors’ Map 14H Block 57 Lot B11A.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition.  The existing dwelling is nonconforming in that it is located 30.5 feet from Shane Drive, 27.2 feet from Bishops Terrace where a 40 foot setback is required, and is located 17.2 feet from the westerly abutter.  The proposed addition will be nonconforming in that it will be located 13.4 feet from the westerly abutter where a 25 foot setback is required.  The existing building coverage is 2,102 square feet (18.7%) and the proposed building coverage is 2,324 square feet (20.8%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 11,255 square feet where 40,000 square feet is required in the R40 Zoning District. A Special Permit is required under M.G.L Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.  Scheduled for March 26, 2020.

Application No. 20-013: Christina and William Long, c/o Peter Burns, 52 Souwest Drive, Harwich, MA 02645, owner of property located at 257 Round Cove Road, also shown on the Town of Chatham’s Assessors’ Map 8J Block 33 Lot C282.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition.  The existing dwelling is nonconforming in that it is located 20 feet from the easterly and westerly abutters.  The proposed addition will be nonconforming in that it will be located 21 feet from the easterly abutter where a 25 foot setback is required.  The existing building coverage is 2,367 square feet and the proposed building coverage is 2,402 square feet where 2,850 square feet is the maximum allowed.  The lot is nonconforming in that it contains 135 feet of frontage where 150 feet is required and contains 21,200 square feet where 60,000 square feet is required in the R60 Zoning District. A Special Permit is required under M.G.L Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw. 

Application No. 20-014: 34 Chatham Village Trust, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA 02671, owner of property located at 34 Holway Street, also shown on the Town of Chatham’s Assessors’ Map 17C Block 37 Lot 16A.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and garage and the construction of a new dwelling.  Also proposed is the construction of a new driveway and extension of an existing footpath as allowed by Special Permit under Sections IV.A.3.a. and IV.A.3.d. of the Bylaw.  The existing dwelling is nonconforming in that it is located 21.3 feet from the road and within the Coastal Conservancy District.  The proposed dwelling will be nonconforming in that it will be located 21.3 feet from the road where a 25 foot setback is required and will remain within the Coastal Conservancy District where a 50 foot setback is required. The lot is nonconforming in that it contains 2,460 square feet of buildable upland where 20,000 square feet is required. The lot contains 39,914 square feet in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Chatham Protective Bylaw.

Application No. 20-015: Edward Acton, owner of property located at 48 Hillcrest Road, also shown on the Town of Chatham’s Assessors’ Map 15H Block 53 Lot M7.  The Applicant seeks to modify Special Permit No. 19-087 granted on November 21, 2019, which allowed for the demolition of the existing dwelling and the construction of a new dwelling.  The Applicant now seeks to modify Special Permit No. 19-087 to allow for the proposed dwelling to be located 20 feet from the southerly abutter where a 25 foot setback is required.    The building coverage of 2,692 square feet (14.9%) and all other setbacks approved under Special Permit Nos. 19-087 will remain unchanged.  The lot is nonconforming in that it contains 18,040 square feet where 40,000 square feet is required in the R40 Zoning District.   A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Protective Bylaw.

Application No. 20-016: John W. Jannell, c/o Dan Croteau, 941 Main Street, Harwich, MA 02645, owner of property located at 139 Pine Knoll Avenue, also shown on the Town of Chatham’s Assessors’ Map 5C Block 47 Lot S59.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the elevation of the existing dwelling.  Also proposed is the reconstruction of an existing deck and the construction of new stairways.  The existing dwelling is nonconforming in that it is located 28 feet from the Coastal Conservancy District (Flood Plain ele. 12).  The proposed elevated dwelling and reconstructed deck will be nonconforming in that the deck will be located 28, feet from the Coastal Conservancy District where a 50 foot setback is required.  The building coverage will remain 830 square feet (10.3%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 8,102 square feet where 20,000 square feet is required in the R20 Zoning District. A Special Permit is required under M.G.L Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 20-017: Caroline C. Roberts, c/o Benjamin Zehnder, Esq., PO Box 2300, Orleans, MA 02653, owner of property located at 35 Stillwater Road, also shown on the Town of Chatham’s Assessors’ Map 9J Block 33 Lot Sw11.  The Applicant proposes to construct a detached garage with a second floor Accessory Dwelling Unit (ADU) on a nonconforming lot which requires the grant of a Special Permit.  The lot is nonconforming in that it contains 36,934 square feet where 60,000 square feet is required in a R60 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 9 and Sections VIII.D.2.b. of the Chatham Protective Bylaw.
