LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, March 27, 2014, starting at 2:30 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 13-088: William F. Hester, 63 Beach Avenue, South Dartmouth, MA  02748, owner of property located at Lot 105 Stage Island Road, Chatham, MA  02650, also shown on the Town of Chatham Assessors’ Map 14A2, Block 9, Lot D38.  The appellant proposes to construct a two bedroom single family home on elevated pilings on a vacant 40,768 square foot lot.  Proposed single family home will meet frontage and setback requirements but does not have adequate upland.  The Appellant seeks the following Variances; a Variance from Section III D.3.a.1 Upland Requirements of 10,000 square feet of buildable upland for a house lot created prior to 1984 in an R-40 Zoning District, a Variance from Section IV 3. a. Height restriction, and a Use Variance from Section IV 4.d. Conservancy District of the Protective Bylaw.  Continued from February 13, 2014.    

Appeal No. 14-012: John S. and Carrie A. Fahle, 25 Bay View Road, South Chatham, MA  02659, c/o William F. Riley, Esq., 154 Crowell Road, Box 707, Chatham, MA 02633, owner of property located at 2504 Main Street, Chatham, MA, also shown on the Town of Chatham’s Assessors’ Map 3D, Block 54, Lot 24. The appellant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via the relocation of the antique barn and construction of a guesthouse.  The existing barn is nonconforming in that the abutter’s setback is approximately 10 feet where 20 feet is required.  The existing dwelling is nonconforming as it is setback approximately 10 feet from the road where 50 feet is required.  The existing building coverage is 3,442 square feet (7.7%) and the proposed building coverage will be 4,497 square feet (10.3%), where a maximum of 10% is required, creating a new nonconformity.  The lot is nonconforming in that it contains 44,845 square feet where 60,000 square feet is required in the R60 zoning district but 20,000 is required in the SB District.  The lot is in both the SB and R60 Zoning Districts.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-013: 475 Main Street, LLC, PO Box 1348, West Chatham, MA  02669, c/o Michael D. Ford, PO Box 485, West Harwich, MA  02671, owner of property located at 471 and 475 Main Street, Chatham, also shown on the Town of Chatham’s Assessors’ Map 15D, Block 78, Lot 51 and Map 15D, Block 77, Lot 49. The appellant is seeking to modify Special Permit #12-097 by amending condition number one of the Decision, to allow the number of accessory apartments to be increased to three (3) with a combined total of five (5) bedrooms.  The result will be one building containing retail space on the first floor and three (3) apartments and mezzanine space on the second floor.    475 Main Street is nonconforming in that it is located one (1) foot from the road where a five (5) foot setback is required.  The property is within the GB1 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-014: Diane Chapman, 12 Monmouth Ct., Brookline, MA  02446, c/o William F. Riley, Esq., 154 Crowell Road, Box 707, Chatham, MA 02633, owner of property located at 81 Holway Street, Chatham, MA, also shown on the Town of Chatham’s Assessors’ Map 17C, Block 27, Lot 28. The appellant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via the construction of steps that will be 23.4 feet from the Coastal Conservancy District where 50 feet is required and constructing steps that will be 7.3 feet from the northerly abutter’s setback where 15 feet is required.  Also proposed are a small second floor cantilever and a second floor deck on the water side.  The existing dwelling is nonconforming on the north side as it is 9.5 feet from the abutter’s setback where 15 feet is required and on the south side the abutter’s setback is 14.2 feet where 15 feet is required; and further, the dwelling is 16.5 feet from the road setback where 25 feet is required.  The proposed building coverage will be 21.9% where 15% is allowed.  The existing lot is nonconforming as it contains 9,400 square feet where 20,000 square feet is required.  The lot is in the R20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-011: On Shore at Last, LLC, 104 Crowell Road, Chatham, MA  02633, c/o Michael D. Ford, PO Box 485, West Harwich, MA  02671, owner of property located at 157 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16D, Block 33, Lot 40. The appellant proposes to change, alter, or expand a nonconforming structure with attached garage by demolishing the existing structure and reconstructing a single family dwelling, detached garage with a one bedroom guestroom, and pool.  The existing structure is nonconforming in that the northern abutter’s setback is 16.8 feet and the southern abutter’s setback is 21.5 feet where 25 feet is required.  The lot is nonconforming in that it has 136.3 feet frontage where 150 feet is required.  The Appellant seeks to raze and rebuild a new five bedroom dwelling which will have a foot print of 4,391 square feet, and proposed garage with one bedroom which will have a footprint of 1,080 square feet, and will result in total building coverage of 5,471 square feet or 9.7% where 10% is allowed.  The proposed structure will conform to setback requirements.  The property is within the R-40 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw. Continued from March 13, 2014.
