LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, June 25, 2015, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-031: Janet Gove Dugan, Trustee, Janet Gove Dugan Trust, c/o Andrew Singer, Esq., 26 Upper County Road, P. O. Box 67, Dennisport, MA 02639, owner of property located at 0 and 16 Little Beach Road, also shown on the Town of Chatham’s Assessors’ Map 16A Block 35 Lot H41A and Lot H40A.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is wholly within the Coastal Conservancy District where 50 feet is required.  The existing dwelling is also nonconforming in that it has a road setback of 35.9 feet where 40 feet is required, a westerly abutter’s setback of 24.8 feet where 25 feet is required, a southerly abutter’s setback of 14 feet where 25 feet is required, and a ridge height of 20.03 feet where 20 feet is the maximum.  The original lot is nonconforming in that it contains 6,049 square feet where 40,000 square feet is required and contains 0 square feet of buildable upland where 20,000 square feet is required but the lot will become less nonconforming when the vacant abutting lot (Lot 40A) is added to the existing lot. The proposed dwelling will have a road setback of 33 feet (covered front stoop) where 40 feet is required, a westerly abutter’s setback of 16 feet where 25 feet is required and the ridge height will be 29 feet where 20 feet is the maximum allowed.   The two lots combined will be 10,705 square feet where 40,000 square feet is required within the R-40 Zoning District.  A Special Permit is required under Sections IV and V.B., of the Chatham Protective Bylaw and M.G.L. Chapter 40A, Section 6.  

Application No. 15-028: Charles and Sandra Giorgetti, c/o Sara Hamilton, Reef Realty, 24 School Street, West Dennis, MA  02670, owners of the property located at 51 Olde Towne Lane, also shown on the Town of Chatham’s Assessors’ Map 10H Block 4 Lot L5.  The Applicants seek to change, alter or extend a dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling has a setback from the Inland Conservancy District of 31.4 feet and the proposed dwelling has a setback from the Inland Conservancy District of 25.6 feet where 25 feet is required.  The existing building coverage is 1,764 square feet (4.9%) and the proposed building coverage is 1,804 (5.0%) where 10% is the maximum allowed.  The lot is nonconforming in that it has 108.03 feet of frontage where 125 feet is required.  The lot is also nonconforming in that it contains 36,269 square feet where 60,000 square feet is required in the R60 Zoning District.  A Special Permit is required under Section VB of the Chatham Protective Bylaw.  

Application No. 15-029: KAHR Holdings, LLC, c/o Peter Polhemus, Polhemus Savery DaSilva, 101 Depot Road, Chatham, MA  02633, owner of the property located at 1 Isaac Hardy Lane, also shown on the Town of Chatham’s Assessors’ Map 16D Block 60 Lot 1.  The Applicant seeks to amend Special Permit No. 06-008 Condition No. 4 to allow the removal of two large willow trees and replace them with seven large caliper trees.  The property contains 23,485 square feet and is located in the GB2 and R20 Zoning Districts.  M.G.L. Chapter 40A, Section 14 authorizes the Zoning Board of Appeals to make orders or decisions, reverse or affirm in whole or in part, or modify any order or decision.    

Application No. 15-030: James H. and Martha R. Higgins, c/o Michael D. Ford, 72 Main Street, Box 485, West Harwich, MA  02671, owners of the property located at 39 Wapoos Trail, also shown on the Town of Chatham’s Assessors’ Map 14A3 Block 12 Lot N88.  The Applicants seek to change, alter or extend a nonconforming dwelling on a conforming lot via the demolition of the existing dwelling and the construction of a new dwelling and pool.  The existing dwelling is nonconforming in that it has a westerly abutter’s setback of 39.5 feet where 40 feet is required, and has a setback from the Conservancy District of 24 feet where 50 feet is required.    The proposed dwelling will conform to the westerly abutter’s setback of 41.5 feet where 40 feet is required but will continue to be nonconforming with a 40 foot setback from the Conservancy District where 50 feet is required.  The proposed pool will have an easterly setback of 40.3 feet where 40 feet is required.  The existing building coverage is 2,093 square feet (6.1%) and the proposed building coverage will be 3,225 square feet (9.4%) where 10% is the maximum allowed.  The lot is conforming in that it contains 57,638 square feet where 40,000 square feet is required in the R40A Zoning District.  A Special Permit is required under Section VB of the Chatham Protective Bylaw.  

Application No. 15-026: Wendy DeFeudis, 91 Coles Pond Drive, South Dennis, MA  02660, agreed leasee of the property located at 2570 Main Street, also shown on Assessors Map 3D, Block 48, Lot 19.  The Appellant is requesting the grant of a Permit by the Sign Code Appeals Committee to place a ground sign on the front area facing Main Street.  In the Chatham Sign Code, Section 225-24 B. states “One single- or double-faced sign per property advertising an allowed business use which shall not exceed six square feet per face.”  The Applicant is seeking approval for a 48 inch by 56 inch, 18.4 square foot ground sign.  The ground sign is in addition to a proposed wall sign which complies with the Sign Bylaw.  The Zoning District is Small Business (SB) and the lot contains 5,688 square feet where 20,000 square feet is required.   A Permit is sought under Section 225-19 of the Chatham Sign Code, which allows for the grant of a permit varying the specific requirements of the Bylaw when the site is appropriate, the signs will not be a nuisance or adversely affect the neighborhood, and the requirements for the permit are in accord with the general spirit and intent of the Bylaw.
