LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold an executive session on Thursday, August 14, 2014, starting at 2:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, to discuss ongoing litigation.

Following the executive session the Chatham Zoning Board of Appeals will hold public hearings on the following appeals:

Appeal No. 14-050: Eastward Companies, c/o James M. Norcross, Esq., Po Box 707, Chatham, MA  02633, owner of property located at 20 Dune Drive, also shown on the Town of Chatham’s Assessors’ Map 16A, Block 11, Lot C7. The appellants seek to change, alter, or extend a nonconforming dwelling via the demolition the existing dwelling and construction of a new dwelling with a deck and swimming pool.  The existing dwelling is nonconforming in that it is located entirely within the Coastal Conservancy District where a 50 foot setback is required.  The existing dwelling is also nonconforming as it is 25 feet in height, exceeding the maximum allowable height of 20 feet.  The lot is nonconforming as it contains 27,363 square feet where 40,000 is required and 0 buildable upland where 20,000 square feet is required. The existing building coverage is 2,365 square feet and the proposed building coverage is 2,470 square feet where 2,950 square feet is allowed.   The proposed dwelling will be 40.9 feet in height, thereby exceeding the maximum allowable height of 20 feet in the Coastal Conservancy District.  The proposed structures will meet all other abutter and road required setbacks.  The Zoning District is R-40.  A Special Permit is required under Section V.B., and IV.A.3. of the Chatham Protective Bylaw.  

Appeal No. 14-051: Mimi Jigarjian Trustee Highland Realty Trust, c/o Rubin & Rudman, 50 Rowes Wharf, Boston, MA  02116, owner of property located at 119 Highland Ave, also shown on the Town of Chatham’s Assessors’ Map 15E, Block 56A, Lot 45A. The appellants seek to modify Special Permit No. 14-001 to allow for a second story access stair, located on the northwesterly side of the dwelling.    The existing northwesterly abutter’s setback is 16 feet and the proposed northwesterly abutter’s setback is 11.2 feet where 15 feet is required, thereby creating a new nonconformity.  The lot is 10,435 square feet and the Zoning District is R-20.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-052: Jeffrey K. and Patricia Lines, c/o William F. Riley, 154 Crowell Road, Box 707, Chatham, MA  02633, owner of property located at 28 Eel River Road, also shown on the Town of Chatham’s Assessors’ Map 4C, Block 49A, Lot MS3. The appellants seek to construct an elevated staircase on the coastal bank and within the Conservancy District to provide access to Taylor Pond.  The lot is 14,500 square feet and the Zoning District is R-20.  A Special Permit is required under Section IV.A.3. of the Chatham Protective Bylaw.  

Appeal No. 14-038: David and Michele Mittelman, 16 Rolling Lane, Dover, MA  02030, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 840 Fox Hill Road, also shown on the Town of Chatham’s Assessors’ Map 12L, Block 12, Lot H2. The appellant proposes to modify the existing dwelling by removing the existing structure above the first floor deck and replacing the first and second floors.  The existing dwelling is nonconforming in that it is 21.9 feet from the Coastal Conservancy District where 50 feet is required. The existing building coverage is 3,725 square feet (9.2%), the proposed dwelling has a building coverage of 5,080 square feet (12.5%) where 4,056 square feet (10%) is allowed, thereby creating a new nonconformity.  The proposed dwelling will have a height of 30 feet above the average grade plane, meeting the Protective Bylaw restriction.  Also proposed is to demolish and rebuild the nonconforming garage/guesthouse.  The existing garage/guesthouse is nonconforming in that it is located 25.2 feet from the road where 40 feet is required.  The proposed garage/guesthouse will be same footprint and relocated on the lot to meet the required setbacks.  The lot contains 40,565 square feet of upland and is nonconforming in that it contains a main dwelling and a guesthouse where there is sufficient land for only one dwelling.  The Zoning District is R-40.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.
