LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, May 19, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-020: Jeffrey and Jane Chandler, c/o William F. Riley, Esq., 156 Crowell Road, Chatham, MA  02633, owners of the property located at 24 Windmill Lane, also shown on the Town of Chatham’s Assessors’ Map 16A Block 18 Lot H2.    On Remand from the Massachusetts Appeals Court, the Applicants seek to determine whether the applicant’s proposed new structure is eligible for the exemption under Section IV.A.3 of the Chatham Protective Bylaw.  The Applicants also propose to modify the dwelling design previously approved in Special Permit No. 07-119.  The existing dwelling is nonconforming in that it has a northeasterly abutter’s setback of 10 feet and a southwesterly abutter’s setback of 20 feet where 25 feet is required.  The existing dwelling is also nonconforming with a road setback of 38 feet where 40 feet is required and contains no buildable upland as it is located wholly within the Coastal Conservancy District where a setback of 50 feet is required. The existing dwelling height is 19.2 feet and the proposed dwelling will be 27.7 feet high where 20 feet is the maximum allowed. The proposed dwelling will be nonconforming in that its northeasterly abutter’s setback will be 10 feet and the southwesterly abutter’s setback will be 22 feet where 25 feet is required and the road setback will be 36 feet where 40 feet is required.  In December 2007, the Applicants were granted Special Permit No. 07-119 which allowed the Applicants to demolish the main dwelling and garage re-construct a new dwelling and garage.  The Decision was appealed to the Land Court, then to the Massachusetts Appeals Court, and subsequently remanded back to the Town.  The lot is nonconforming as it contains 29,200 square feet where 40,000 square feet is required in an R-40 Zoning District.  A Special Permit is required under M.G.L Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.
