LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, June 23, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-035: John and Janine Scott, c/o T. Stephen Smith, PO Box 616, South Chatham, MA  02659, owners of the property located at 78 Kemah Road, also shown on the Town of Chatham’s Assessors’ Map 8B Block 22 Lot H54.  The Applicant seeks to change, alter or extend a nonconforming dwelling on a nonconforming lot via the removal of an existing nonconforming deck and stairs and construction of a new deck.  The existing dwelling and retaining wall were approved by a Variance (Application No. 92-18). The proposed deck is nonconforming in that it is located wholly within the setback to the Conservancy District where a 50 foot setback is required.  The lot is nonconforming in that it contains 12,267 square feet of buildable upland where 20,000 square feet is required and contains 16,375 square feet where 20,000 square feet is required in an R20 Zoning District.  An amendment to the Variance is required under Section VIII.D.2.c. of the Chatham Protective Bylaw.  

Application No. 16-040: Robin Hess Comfort, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owners of the property located at 89 Mooncussers Lane, also shown on the Town of Chatham’s Assessors’ Map 11A Block 16 Lot F.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and construction of a new dwelling.   The existing dwelling is nonconforming in that it is located 40 feet from the Coastal Conservancy District.  The proposed dwelling will also be nonconforming in that its setback 39 feet from the Coastal Conservancy District where a 50 foot setback is required. The existing building coverage is 2,486 square feet (4.1%) and the proposed building coverage is 3,110 square feet (5.1%) where 15% is the maximum allowed.  The lot is conforming in that it contains 68,871 square feet in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 15-044: Erik T. Mitchell, c/o Jason Ellis, PO Box 81, North Eastham, MA 02651, owner of property located at 271 Training Field Road, also shown on the Town of Chatham’s Assessors’ Map 81 Block 71 Lot C24.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of mudroom addition on the northerly side and deck on the southeasterly side of the dwelling.  Also proposed is the conversion of a portion of the existing finished basement to a family occupied one (1) bedroom guest unit.  The proposed addition and deck will comply with the required setbacks.  The existing dwelling is nonconforming in that it has a road setback of 37.5 feet where 40 feet is required.  The existing building coverage is 1,773 square feet (8.76%) and the proposed building coverage is 1,906 square feet (9.41%) where 10% is the maximum allowed.   The lot is nonconforming in that it contains 135 feet of frontage where 150 feet of frontage and contains 20,250 square feet where 60,000 square feet is required in the R-60 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  The Applicant is also seeking a waiver as allowed under Section VII.B.12.D. for the additional land area requirement for a one (1) bedroom guest unit which is part of the principal dwelling and is occupied by a member of the immediate family.  

Application No. 16-043: Thomas and Michelle Jennings, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owners of the property located at 154 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16D Block 17 Lot 28.  The Applicants seek to change, alter or extend an existing single family dwelling on a nonconforming lot via the construction of additions, relocation and reconstruction of portions of the existing structure, construction of a new garage and construction of a swimming pool.  The existing dwelling is nonconforming in that it is located 36.2 feet from the Coastal Conservancy District.  The proposed dwelling will conform to the Coastal Conservancy District setback however the proposed pool will be nonconforming in that its setback 31.9 feet from the Coastal Conservancy District where a 50 foot setback is required. The existing building coverage is 1,624 square feet (7.5%) and the proposed building coverage is 2,704 square feet (12.4%) where a maximum of 2,850 square feet is allowed.  The lot is nonconforming in that it contains 30,135 square feet where 40,000 square feet is required and contains 18.53 feet of frontage where 150 feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.
