All appeals originally scheduled for October 10, 2013, will be heard on Thursday, October 17, 2013. The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, October 17, 2013, starting at 4:00 PM in the Town Annex Meeting Room, 261 George Ryder Road to hear the following appeals: Appeal No. 13-051: Ian & Joanne MacDonald, 67 Potash Road, Mansfield, MA 02048, owners of property located at 55 George Ryder Road, also shown on Assessors’ Book Page 8E as Lot 18. Continued from the September 12, 2013 public hearing, the appellants propose to expand a nonconforming single family dwelling via the demolition of an existing dwelling and construction of a new dwelling. The proposed new dwelling will comply with the dimensional requirements of the Protective Bylaw, however, because the new dwelling will be constructed in a different location on the lot, it is not technically an extension, reconstruction, structural change or alteration of a nonconforming single family dwelling and the Second Except clause of Section 6 of M.G.L., Chapter 40, The Zoning Act requires the grant of a Special Permit. The existing dwelling is nonconforming in that it is located 6.1 feet from the northerly lot line where a 15 foot setback is required. The lot is nonconforming in that it contains 11,662 sq. ft. where 20,000 sq. ft. is required, and 0.0 linear ft. of frontage where 100 ft. is required. The Zoning District is R-20. The appellants propose to expand a nonconforming single family dwelling via the addition of a second story, 32 feet from a Coastal Conservancy District (Flood Plain, el. 10) where a 50 foot setback is required. The existing dwelling is nonconforming in that it is located 32 feet from a Coastal Conservancy District (Flood Plain, el. 10) where a 50 foot setback is required. The lot is nonconforming in that it contains 16,132 sq. ft. of buildable upland where 20,000 sq. ft. is required. The Zoning District is R-20. Appeal No. 13-060: Edward & April Hovsepian, 25 Pond Brook Circle, Weston, MA 02493, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA 02633, owners of property located at 446 Old Harbor Road, also shown on Assessors’ Book Page 16G as Lot K2. The appellants propose to expand a nonconforming single family dwelling via the addition of an 18 foot by 18 foot master bedroom & bath on the northerly side, 14.3 feet from the easterly lot line where a 25 foot setback is required. Additionally proposed is the extension of an existing retaining wall with an exposed face in excess of 3 feet in height (4.5 ft. ) on the northeasterly side, 4.5 feet from the lot line where a 25 foot setback is required. The existing dwelling is nonconforming in that it is located 19 feet from the road where a 40 foot setback is required and 2.8 feet from the easterly lot line where a 25 foot setback is required. The lot is nonconforming in that it contains 10,473 sq. ft. where 40,000 sq. ft. is required. The Zoning District is R-40. A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw. Appeal No. 13-061: Kevin & Kendra Seth, 8 Wing Road, New Canaan, CT 06840, c/o Aaron Polhemus, Polhemus, Savery & DaSilva, 101 Depot Road, Chatham, MA 02633, owners of property located at 45 Cranberry Lane, North Chatham, also shown on Assessors’ Book Page 15J as Lot 9. The appellants propose to expand a nonconforming single family dwelling via the removal of an existing porch on the northerly side and the addition of a 7.66 foot by 13’ 10” living area in the former porch location, with another addition of 117 sq. ft., a 140 sq. ft. porch and a 25 sq. ft. covered entry. The building coverage will increase from an existing 2,902 sq. ft. to 3,184 sq. ft. where a maximum of 2,950 sq. ft. is allowed. The existing dwelling is nonconforming in that it is located 6.7 feet from the easterly lot line where a 25 foot setback is required. The lot is nonconforming in that it contains 34,690 sq. ft. where 40,000 sq. ft. is required, and contains a main dwelling and a guest cottage where there is sufficient land area for only 1 dwelling. The Zoning District is R-40. A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.
