(MGL Ch. 30A, Sections 21 #3, Discuss strategy with respect to litigation and that the Chairman declares that an Open Meeting may have a detrimental effect on the litigating position of the body.  (Joint meeting with the Board of Selectmen).

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, January 10, 2013,  starting at  4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 12-113:  Andrzej Krolewski, 639 Great Plain Ave., Needham, MA  02492, c/o Thomas Moore, Thomas A. Moore Design Co., P.O. Box 2124, Brewster, MA  02631, owner of property located at 30 Uncle Levi’s Lane, also shown on Assessors’ Book Page 2A as Lot E13.  The appellant proposes to expand a nonconforming single family dwelling via the addition of a dining room and an expansion of an existing bedroom on the westerly side, 10.7 feet and 14.1 feet from the westerly lot line,  respectively,  where a 15 foot setback is required.  The existing dwelling is nonconforming in that it is located 14.5 feet from the northerly lot line where a 15 foot setback is required.  The lot is nonconforming in that it contains 8,107 sq. ft. where 20,000 sq. ft. is required and 84.36 linear ft. of frontage where 100 ft. is required.   The Zoning District is R-20.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change,  of the Protective Bylaw. 

Appeal No. 12-114:  Steve & Jacque Casey, 538 Washington St., E. Walpole, MA  02032, c/o Theodore P. Streibert, AIA, 15 Linden Tree Lane, Chatham, MA  02633, owners of property located at 167 Orleans Road, also shown on Assessors’ Book Page 15H as Lot 4.  The appellants propose to expand a nonconforming single family dwelling via the addition of a screened porch on the easterly side, 12 feet from the southerly lot line, a dormer on the southerly side, both additions within the required 25 foot setback,  and expand an existing master bedroom on the northwesterly side, 22.44 feet from the westerly lot line where a 25 foot setback is required.  Also proposed is a covered porch on the northerly side, 33.52 feet from the road where a 40 foot setback is required. The existing dwelling is nonconforming in that it is located 11.82 feet from the southerly lot line where a 25 foot setback is required.  The lot is nonconforming in that it contains 12,855 sq. ft. where 40,000 sq. ft. is required.        The Zoning District is R-40.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change,  of the Protective Bylaw.

12-116:  Michael Barnett, 64 Thompson Drive, Sudbury, MA  01776, c/o Kevin Boyar, P.O. Box 21, W. Barnstable, MA  02668, owner of property located at 38 Dugans Pond Road, also shown on Assessors’ Book Page 15E as Lot D4.  The appellant proposes to expand a nonconforming single family dwelling via the addition of a 26 foot by 12 foot deck on the southerly side, 8 feet from the lot line where a 15 foot setback is required.  The existing dwelling is nonconforming in that it is located 8 feet from the southerly lot line where a 15 foot setback is required. The property contains 22,500 sq. ft. in an R-20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-117:  Paul Hoogenboom & Carolyn Seymour, 131 Hudson St., Hudson, OH  44236, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 36 Great Hill Road, also shown on Assessors’ Book Page 13G as Lot C3.  The appellants propose to expand a nonconforming single family dwelling via the addition of a 22 foot by 24 foot garage with office above and an 11 foot by 7 foot connector on the easterly side, 25.6 feet from the road where a 40 foot setback is required, and 15.3 feet from the easterly lot line where a 25 foot setback is required.  Additionally proposed is a 14 foot by 19 foot sunroom on the northwesterly side.  The building coverage will increase from an existing 8.7% (953 sq. ft.) to 17.5% (1,929 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 24.7 feet from the road where a 40 foot setback is required and 24.4 feet from the westerly lot line where a 25 foot setback is required.  The lot is nonconforming in that it contains 11,000 sq. ft. where 40,000 sq. ft. is required and 110 linear ft. of frontage where 150 ft. is required.   The Zoning District is R-40.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.
