The following hearings held by the Chatham Conservation Commission are in accordance with the provisions of the Massachusetts Wetlands Protection Act (MGL Ch 131, s 40), and the Chatham Wetlands Protection Bylaw (Chapter 272).  

The following applicants have filed Requests for Determination of Applicability:
30 Black Duck Landing, Richard Berner: Proposed replacement of lawn area; proposed removal of stumps and proposed mitigation plantings at 30 Black Duck Landing Assessors Map 12B parcel B6.

175 Sears Road, Charlotte M Mitchell: Re-opening of hearing for proposed installation of chain link fence; proposed removal of vegetation to facilitate installation of fencing at 175 Sears Road, Assessors Map 11A parcel 2A Revised plans have been received

The following applicants have filed  Requests to Amend an Order of Conditions: 
161 Landing Lane, Schuyler & Penelope Peck-applicants, John R Frazee Trust, Priscilla A Frazee Trust, Richard A Frazee & Marcy J T Smith-owners, SE 10-2806:  Request to Amend an existing permit under SE 10-2806 to include proposed construction of a larger house on a different footprint at 161 Landing Lane, Assessors Map 13K parcel R10.  On October 3rd, pursuant to DEP policy 85-4 the Commission voted not to accept a request to amend the Order, therefore the applicant will be filing a new Notice of Intent.  This application has been withdrawn.

414 Fox Hill Road, Christopher & Kathleen LaCroix, SE10-2734: Re-opening of hearing for a request to amend the existing Order of Conditions under SE 10- 2746 to include elimination of garage, construction of air conditioning enclosure, and installation of an outside shower and steps at 414 Fox Hill Road, Assessors Map 11M parcel 2.                                    

The following applicants have filed Notices of Intent: 
141 Landing Lane, Charles H Boehm & Eileen A Hussey-Boehm-applicant, Boehm Nominee Trust-owner, SE 10-: Proposed removal of existing dwelling; proposed construction of a new dwelling with new septic , grading & landscaping at 141 Landing Lane, Assessors Map 13K parcel R8.  Requires a Special Permit is required; not scheduled     

79 Kent Road, Paul T & Judith H Peterson, SE 10-: Proposed second story addition with dormers & balcony; proposed replacement of brick patios with wooden decks at 79 Kent Road, Assessors Map 12J parcel G5. Requires a Special Permit; scheduled on ZBA agenda for Dec 6, 2012 

42 & 45 Old Harbor Lane; Peter Harriss-owner/applicant & Holly Todd, PH.D-owner, SE 10-: Proposed invasive species removal; proposed treatment of invasives and re-planting with native species at 42 & 45 Old Harbor Lane, Assessors Map 16-I parcels MD2 & MR1.   Applicant needs to correct abutter notification and re-advertise the project and has asked the hearing be continued to November 7, 2012. 

21 Young’s Farm Road, Consuelo Berghausen, SE 10- 2836: Re-opening of hearing for proposed first floor addition on north side of dwelling; proposed addition on pier foundation and proposed deck expansion at 21 Young’s Farm Road, Assessors Map 9D parcel G2. Special Permit granted on October 11 by ZBA; Revised plans rec’d.

86 Capri Lane, Capri Lane Association LLC, c/o John Andres, Manager, SE10-2840: Re-opening of hearing for proposed construction and licensing of a pier, ramp & float in Oyster Pond at 86 Capri Lane, Assessors Map 13C parcel between Parcels C12 & C13 – ZBA application received, no ZBA hearing date has been scheduled to date.

174 Eastward Road, John/Jamie Selldorff, SE 10-2812: Re-opening of hearing for proposed renovations and additions to existing dwelling; removal of existing concrete structures, beach nourishment, concrete seawall repair, landscape improvements and mitigation plantings at 174 Eastward Road. The ZBA granted a Special Permit on September 27, 2012 with the agreement that if the applicant makes significant changes in landscaping, the ZBA will review the changes. 

52 Nickerson Lane, 52 Nickerson Lane LLC-owner, Stratford Wallace-applicant, SE 10-2825: Re-opening of hearing for the proposed beach access stairs now to be within the revetment from the top of the coastal bank to the coastal beach; addition of a beach nourishment at 52 Nickerson Lane, Assessors Map 7B parcel S16A.  Special Permit required; ZBA hearing continued to October 25, 2012. 

448 Shore Road, John & Cynthia Leahy-applicants, Cynthia L Leahy 2011 Revocable Trust-owner, SE 10-2838: Re-opening of hearing for proposed razing of existing dwelling & construction of a new dwelling on an expanded footprint; proposed construction of pool, new driveway and utilities at 448 Shore Road, Assessors Map 16F parcel 10.  Revised site plans; Landscape plans and Land Management Plans have been received; Special Permit granted by ZBA on Oct 11, 2012. 

Off Strong Island Road-Fox Pond, Fox Pond Association c/o Joan Drury-applicants, SE10-2819: Re-opening of hearing for proposed pond maintenance and control of nuisance aquatic species at Fox Pond off Strong Island Road, Assessors Map 13M parcel B6b.  Special Meeting to be held
