The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, July 26, 2012, starting at  4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 12-064:  Robert Bannish, Trustee, Mahalo Realty Trust, 50 Congress St., Suite 1025, Boston, MA  02109, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owner of property located at 35 Sears Road, also shown on Assessors’ Book Page 12A as Lot 12.  The appellant is requesting the grant of a Special Permit to install four (4) sections of stockade fencing in a Coastal Conservancy District (Flood Plain, el. 10).  The property contains 60,100 sq. ft. in an R-40 Zoning District. A Special Permit is required under Section IV.A.3.a., Overlay Regulations, Conservancy Districts, Special Permit Uses, of the Protective Bylaw.

Appeal No. 12-065:  Gillis S. & Lori W. Cashman, 3 Edgar Walker Ct., Hingham, MA  02043, c/o Michael D. Ford, Esq., P.O. Box 485, W. Harwich, MA  02671, owners of property located at 173 Main Street, also shown on Assessors’ Book Page 16C as Lot 50.  The appellants propose to expand and alter a nonconforming single family dwelling via the demolition of a 23.5 foot by 41 foot one-story wing and construction of a new, approximately 55 foot by 28 foot, 2-story wing with deck on the westerly side, 14 feet from the southerly lot line and 12 feet from the northerly lot line where a 15 foot setback is required from each lot line.  The existing dwelling is nonconforming in that it is located 9.8 feet from the northerly lot line and 12.9 feet from the southerly lot line where a 15 foot setback is required from each lot line.  The lot is nonconforming in that it contains 13,175 sq. ft. where 20,000 sq. ft. is required, and 79.82 linear ft. of frontage where 100 ft. is required.  The property contains 13,175 sq. ft. in an R-20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-066:  Manson P. & Alison K. Hall, P.O. Box 328, No. Chatham, MA  02650, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 349 Whidah Road, also shown on Assessors’ Book Page 13K as Lot W11.  The appellants propose to expand and alter a nonconforming single family dwelling via a 7.1 foot by 22.5 foot addition on the westerly side over an existing concrete slab at the basement level, and the addition of a 22.5 foot by 7.2 foot elevated deck, within a Coastal Conservancy District (Coastal Bank) where a 50 foot setback is required.  The existing dwelling is nonconforming in that it is located in a Coastal Conservancy District (Coastal Bank) where a 50 foot setback is required.  The property is nonconforming in that it contains another structure which is 17 feet from the Top of Bank where a 50 foot setback is required.  The property contains 82,300 sq. ft. in an R-40 Zoning District.   A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-067:  James & Andrea DuPont, 3 Main Street, Chatham, MA  02633, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 3 Main Street, also shown on Assessors’ Book Page 16B as Lot 57.  The appellants propose to expand a nonconforming single family dwelling via the demolition of an existing garage and breezeway and the construction of additions and a new garage, 10.2 feet from the northerly lot line where a 25 foot setback is required.  A proposed addition on the westerly side is located 15.1 feet from the road where a 40 foot  


setback is required.  The building coverage will increase from an existing 12.1% (1,825 sq. ft.) to 19.5%  (2,941 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 15.1 feet from the road where a 40 foot setback is required and 20.2 feet from the northerly lot line where a 25 foot setback is required, and an existing art studio is located 5 feet from the same lot line and 15.3 feet from the road where a 40 foot setback is required. The lot is nonconforming in that it contains 15,055 sq. ft. where 40,000 sq. ft. is required. The Zoning District is R-40.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-047:   Timothy & Mary Christine Sheehan, 34 Main St., Wenham, MA  01984, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 314 Morris Island Road, also shown on Assessors’ Book Page 15A as Lot H87.  Continued from the June 14, 2012 public hearing for demolition of an existing nonconforming single family dwelling and construction of a new single family dwelling within a Coastal Conservancy District (Flood Plain, el. 9 and Coastal Bank).
