The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, February 28, 2013,  starting at  4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 13-008:  John & Martha Donoghue, 4 Hammond Hill Road, Chatham, MA  02633, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 4 Hammond Hill Road, also shown on Assessors’ Book Page 26B as Lot MH1.  The appellants propose to expand a nonconforming single family dwelling via the addition of 183 sq. ft. on the southerly side, 10 ft. from a Coastal Conservancy District  (Flood Plain, el. 9) where a 50 ft. setback is required.  The existing dwelling is nonconforming in that it is located 1.8 ft. from the northerly lot line where a 15 ft. setback is required  and partially within a Coastal Conservancy District (Flood Plain, el. 9) where a 50 ft. setback is required.  The lot is nonconforming in that it contains 18,789 sq. ft. of buildable upland where 20,000 sq. ft. is required, and the property is nonconforming in that it contains two single family dwellings where there is sufficient land area for only one dwelling.   The property contains 40,921 sq. ft. in an R-20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-009:  James P. Jr. & Valerie T. Mellett, 407 Old Harbor Road, Chatham, MA  02633, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 407 Old Harbor Road, also shown on Assessors’ Book Page 15G as Lot 9.  The appellants propose to expand an existing Bed & Breakfast operation on a nonconforming lot via the addition of a 34.5 foot by 21.1 foot addition containing dining areas, den, and laundry with deck above on the southwesterly side.  The building coverage will increase from an existing 13.2% (2,915 sq. ft.) to 16.9% (3,395 sq. ft.) where a maximum of 15% is allowed.  The existing lot is nonconforming in that it contains 20,050 sq. ft. where 40,000 sq. ft. is required.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw, and under Section VII.B.5., Special Regulations, Specific Standards, Boarding or Rooming House, Tourist Home.  The property contains 20,050 sq. ft. in an R-40 Zoning District.

Appeal No. 13-011:  Robert Smith & Judy Campbell, P.O. Box 3003, Wimberley, TX  78676, c/o Chris Cannon, AIA, P.O. Box 201, Chatham, MA  02633, owners of property located at 21 Indian Trail, also shown on Assessors’ Book Page 8C as Lot S89.  The appellants propose to expand a nonconforming single family dwelling via the removal and enlargement of a screened porch on the northerly side with a roof deck above,  a 373 sq. ft. addition on the first floor on the southerly side, and a 112 sq. ft. second story loft.  The proposed additions will comply with the dimensional requirements of the Protective Bylaw, but are considered a substantial alteration to a nonconforming single family dwelling, and under the Second Except Clause of Section 6 of M.G.L., Ch. 40A,  the Zoning Act, such alteration requires the grant of a Special Permit.  The property is nonconforming in that it contains 11,569 sq. ft. where 20,000 sq. ft. is required.  A Special Permit is also required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw. 

Appeal No. 13-015:  Eastward MBT LLC, Trustee, 155 Crowell Road, Chatham, MA  02633, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633,  owners of property located at 11 Shattuck Place, also shown on Assessors’ Book Page 15D as Lot 73.  The appellants are requesting a Modification of Special Permit 12-030, issued on April 18, 2012, to expand a previously approved rear entrance, adding a 9 foot by 18 foot entry hall/pantry/laundry room, which will comply with the setback requirements of the Protective Bylaw.   Section 14, Powers of Board of Appeals,  of M.G.L., Ch. 40A, The Zoning Act, authorizes the Zoning Board of Appeals to make orders or decisions, reverse or affirm in whole or in part, or modify any order or decision.  The property contains 22,640 sq. ft. in an R-20 Zoning District.

Appeal No. 12-108:  Monomoy Place, LLC, 733-739 Main St., Chatham, MA  02633, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 733-739 Main Street, also shown on Assessors’ Book Page 14E as Lot X1.  Continued from the December 20, 2012 public hearing for expansion and alteration of nonconforming apartments and a single family dwelling.

Appeal No. 12-115:  Anne Bonney, 354 Bridge St., Chatham, MA  02633, c/o Mark Clancy, Cape Associates, P.O. Box 1858, No. Eastham, MA  02651, owner of property located at 354 Bridge Street, also shown on Assessors’ Book Page 16B as Lot 9.  Continued from the January 24, 2013 public hearing for the expansion of a nonconforming garage/shed within a Coastal Conservancy District (Flood Plain, el. 10).
