- 7:15 pm HEARING - THE VILLAGE AT PHOENIX POND – NEIL FOSSILE – TOM DIPERSIO, PRLS  Shaker Rd/Pond View Circle.  MODIFICATION OF SPECIAL PERMIT, PLAN REVIEW.  Hearing continued from February 17, 2011 TO December 15, 2011.  See below for text of Legal Notice.
- APPLE ORCHARD ESTATES – STATUS OF MODIFICATION DOCUMENTS (Lot 23 drainage basin in driveway must be added to the modification docs) (GPR). We are in receipt of a letter from Mrs. Sears to access the swale and the culvert for cleaning when the weather allows.  Jonathan Greeno, Paul Farrar and Dave Berry are meeting at the Sears' property so Dave can see the site and to discuss what needs to be done regarding the Sears's swale and the Town’s culvert on Thursday, August 11, 2011 at 8:30a.m. Swale issues with Sears.  Planning Administrator found North Middlesex Savings Bank to be the owner of the Sears' property. Thomas A. Gibbons, Esquire represents NMSB. Dave Berry contacted Tom and he will get back to him in the next couple of weeks to discuss the drainage issues.

The Shirley Planning Board will conduct a public hearing on February 17, 2011 at 7:00pm (NOTE: CONTINUED TO 11/03/2011 AND TO 12/15/2011 @ 7:15PM.) to consider the petition of The Village at Phoenix Pond for a Modification to Special Permit and Approved Definitive Plan granted September 30, 2002, Site Plan Review & Request for Public Hearing for the modification of the existing permit to allow twelve (12) single family home with no age restrictions per Section 7 of the Protective Zoning Bylaws for: The Village at Phoenix Pond, Shirley, Middlesex County, MA, Assessors Map/Block/Parcel: Parcel ID Map 12, Block E, Lot 17, Zoning: Residential District, Land area in square feet: 679,475 sq. ft.
