The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, April 12, 2012, starting at  4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 12-027:  Martin & Barbara B. Marcus, 5 Laurel Court, Marblehead, MA  01945, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 419 Cedar Street, also shown on Assessors’ Book Page 11B as Lot 13.  The appellants propose to expand a nonconforming single family dwelling via the demolition of an existing dwelling and construction of a new dwelling.  The proposed new dwelling will comply with all of the dimensional requirements of the Protective Bylaw, but because the new dwelling will be constructed in a different location on the lot, it is not technically an extension, reconstruction, structural change or alteration of a nonconforming single family dwelling, the second except clause of Section 6 of M.G.L., Chapter 40, The Zoning Act requires the grant of a Special Permit.  The existing dwelling is nonconforming in that it is located 31.9 feet from the road where a 40 foot setback is required, and the lot is nonconforming in that it contains 17,642 sq. ft. where 40,000 sq. ft. is required. The Zoning District is R-40.   A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-028:  Thomas J. & Mary K. Freytag, 135 Horizon Drive, Chatham, MA  02633, owners of property located at 135 Horizon Drive, also shown on Assessors’ Book Page 12H as Lot C13.  The appellants to expand a nonconforming single family dwelling via the addition of a 12.75 foot by 18.75 foot sunroom on the northeasterly side, 21 feet from the road where a 40 foot setback is required.  The existing dwelling is nonconforming in that it is located 31 feet from the road where a 40 foot setback is required and 21.5 feet from the southerly lot line where a 25 foot setback is required.  The lot is nonconforming in that it contains 24,000 square feet where 60,000 square feet is required.  The Zoning District is R-60.   A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-029:  Lawrence W. Biron, Cove Gallery, 2590 Main Street, So. Chatham, MA  02659, owner of a business located at 2620 Main Street, also shown on Assessors’ Book Page 3D as Lot 9A.  The appellant is requesting the grant of a Permit from the Sign Code Appeals Committee to install a separate, approximately 6 square foot sign on a property where another sign is located.  One 8 square foot sign is allowed for properties containing multiple commercial uses in an SB Zoning District under Section 225.4.C., Regulations for Small Business Zones, of the Chatham Sign Code.  The property contains .75 acres in an SB Zoning District.  A Permit is required under Section 225-19, Appeal Permits, of the Chatham Sign Code.

Appeal No. 12-030:  Paul & Joanne Bergquist, 15 Medicine Bow, Chatham, MA  02633, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 11 Shattuck Place, also shown on Assessors’ Book Page 15D as Lot 73.  The appellants propose to expand and alter a nonconforming two-family dwelling via the removal of a portion of the dwelling and the addition of a covered porch on the southerly side, the addition of a covered porch on the easterly side, a small addition on the northerly side, 8.9 feet from the northerly lot line, the construction of a 20 foot by 24 foot garage, 8.5 feet from the southerly property line where a 15 foot setback is required, the relocation of an existing barn  to the east of the proposed garage and the relocation of the second dwelling unit in the main house to the barn.  The building coverage, at 2,940 square feet, will exceed the maximum allowable building coverage of 2,900 square feet.  The existing dwelling is nonconforming in that it is located 21.5 feet from the road where a 25 foot setback is required and 8.8 feet from the northerly lot line where a 15 foot setback is required.  The existing barn is nonconforming in that it is located 3.89 feet from the southerly lot line where a 15 foot setback is required, and the building coverage, at 2,967 square feet, exceeds the maximum allowable coverage of 2,900 square feet.  The property is nonconforming in that it contains 65.54 linear feet of frontage where 100 feet is required, and contains two dwelling units where there is sufficient land area for only one dwelling unit.   The property contains 22,640 square feet in an R-20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.
 
Appeal No. 12-031:  Toronaga, LLC, P.O. Box 633, No. Chatham, MA  02650, owner of property located at 2435 Main Street, also shown on Assessors’ Book Page  4D as Lot 19BXB.  The appellant is requesting the grant of a Permit from the Sign Code Appeals Committee to replace an oversize sign in an SB Zoning District with a sign of the same size.  One 8 square foot sign is allowed for properties containing multiple commercial uses in an SB Zoning District under Section 225.4.C., Regulations for Small Business Zones, of the Chatham Sign Code.  The property contains .29 acres in an SB Zoning District. A Permit is required under Section 225-19, Appeal Permits, of the Chatham Sign Code.
