The Public Hearing is to provide interested parties with an opportunity to comment on proposals to amend the General By-Laws of the Town of Berlin to be acted upon at the Annual Town Meeting to be held Mary 7, 2012. The proposed amendments to the General By-law would be:
1. To see if the Town will vote to amend the General By-laws of the Town of Berlin by striking Article XII-Earth Removal in its entirety and inserting in its place a new Article XII entitled "Earth Removal and Import". The proposed amendment is sponsored by the Berlin Planning Board. The proposed by-law addresses issues such as permit granting authority, earth removal and import permits, permit applications, performance standards and determination, exempt activities and enforcement.
2. To see if the Town will vote to amend the General By-laws of the Town of Berlin by adding a new "Srticle XIX-Like Kind Soil". The proposed amendment would provide reasonable regulation of the importation into the Town of contaminated media and contaminated debris know as "Like Kind Soils". The proposed by-law amendment addresses permit requirements and application procedures, site considerations and limitations on Like Kind Soil importation.
3. To see if the Town will vote to amend the General B-laws of the Town of Berlin by striking therefrom Article XII-Earth Removal in its entirety and inserting in place thereof a new Article XII entitled "Earth Movement". The proposed amendment is a Citizens Petition. The proposed by-law addresses issues such as minor and major earth movement permits, permit applications, application content, performance standards and determination, security, exempt activities, enforcement and definitions.
